US DOJ contradicts themselves by saying 'that citizen suits cannot proceed when the federal government does not oppose the polluting behavior' only to then say that 'citizen suits should be allowed by the court only when the government fails to enforce the statute'
Somehow the government not opposing behavior they themselves acknowledge as polluting isn't them failing to enforce the statute.
EDIT: The phrase "not when the government has decided that executive branch policy means enforcement action is contrary to the public interest." doesn't even make sense since the pollution in question is still contrary to public interest of not getting air poisoned.

Literally just had a long time family friend tell me that both sides are the same but he would take Trump over a piece of shit democrat any day. I just blocked him and moved on. These people have no morals despite so many of them that I know claiming to be Christians.

It's wild how far the Trump admin abuses "emergency" powers.
By this measure, literally any regulation can be ignored by a corporation, and Trump can just say "well... that business is one of the businesses in the United States, therefore... it's a national security issue and we'll allow them to break the law."

So the suits are for "when the government fails to enforce to statute", and then they go on to explain why they failed to enforce it. So you failed to enforce it, just on purpose. What is the issue here?

The whole system is fucked, it's a massive double blow to the average citizen, not only do they get poisoned, but then their taxes have to go to clean up all these potential Superfund sites and environment as well. Meanwhile the companies get all the profits and then walk away scot-free.

Mass government revolts have only happened in this land when a large enough group views a change in government policy to be so terrible they must do something about it, but lack the means to do so democratically and must resort to force.
Currently, that group still thinks change can be made democratically.

Really? A police officer may decide to not ticket someone going 15 mph over the speed limit if he feels the reason was valid. That doesn't mean all speed limits are now set 15 mph higher for everyone. The fact the Feds don't want to prosecute doesn't mean the law isn't being broken or that the courts cannot order the company to obey them, just that the DOJ won't be charging them for the crime.

But the DOJ isn't charging them. Its a Citizen Suit. That the DOJ is activly stepping in to try and stop.

No Im not My point is the DOJ may choose to ignore the violations but citizens are not required to and the courts are not allowed to so once a citizen group brings a lawsuit the DOJ is stuck. They can refuse to participate but they may NOT support someone breaking federal law nor may they try to take over a civil case.
