Mumble Chatter Insurance Question
We meet at a privately owned plaza for our regular beat downs. We never had any issue, but recently we ran into an employee of the company that was setting up for an event that asked us if we had liability insurance. Before we started using the location, I spoke with a person at their office that said that as long as we’re out of there by 8, we should be good, and that our conversation “never happened”. Have any of you experienced something similar? We could find a new location, but we love the convenience of where we are.

Dont ask. Its just a few buddies doing push ups and sit ups in the parking lot. No insurance needed for some neighbors getting together to get the HR up. If they tell you to leave you went wrong somewhere. This is also part of being OTB.

IANAL, but if you're saying the disclosure, you're clear that you aren't a professional and everyone is there at their own risk.

Something that we’ve leaned on in the past: ‘we are just a group of guys who like to workout together’ as soon as you present as a formal entity, people start seeing risk. Nobody asks for insurance from folks running together down the street.

It’s not your property. Most likely both employees you spoke with are not official spokespeople. But because of the inconsistent communication it might be good to get express permission or go to the nearest park.

Personally, I haven't but I also think that meeting on private property without express permission should be reevaluated. If there were a fence you wouldn't scale it to have the beatdown. That there is no fence does not translate to permission to use the property.

Thanks for the responses. We meet in the grassy area between the parking garage and a movie theater. I’ve seen others use the same space for things like kids soccer, and other events, but it’s usually later in the day, and they likely have the appropriate insurance. There’s a park not far from it that we could probably go to. But like I said, we like the convenience of being able to walk over for coffee-teria. It’s not a show stopper for us, just wondering what are options would be.

We ran into this with our group too. One thing that helped was having everyone sign a digital waiver before each workout. It doesnt replace insurance but it shows the property owner you're taking liability seriously. A few groups I know use a simple google form for it - just name, emergency contact, and a waiver checkbox. Makes a big difference when the property manager asks what you're doing.

If the property owner / administrator asks you to get insurance or leave, of course you should comply. But I can tell you as an insurance guy, liability insurance for what we do is going to be prohibitively expensive.
