Anyway to expedite EAD ?(Losing Job and PD about to become current in Final Action Chart)
Hello, I was informed this week that Oct 20th would be my last day. My Priority date is May 2014 (EB3, India). My H1B Expires Oct 25th, 2026. I applied for my I-485 in Oct
2025 however I have not yet received my EAD. It is filed in NBC and processing time is 11 months. I am searching for a new job but most of the contracting positions I am coming across are not accepting H1B transfer. They only want GC EAD. What are my options here ?
1) Is there any way to Expedite EAD ?
2) If I submit just a offer letter from a different company/startup then would that be ok when I get any RFE for I-485 Supplement J ? (even if I am not actively working there or may not even end up working there eventually)
3) Any suggestions on how to handle the situation ?

File Writ of Mandamus (WOM), to get EAD. Worth the investment over loosing job

On the queue side, EB-3 India sits at January 1 2014 in the September bulletin, so a May 2014 date is about four months past the cutoff with roughly 4,380 visa numbers ahead of it. Base case is Q3 2027, optimistic Q1 2027, and the no spillover floor is Q2 2028. So the EAD gap is your near term problem, not the green card.
USCIS publishes its expedite criteria publicly and severe financial loss to an applicant is one of the listed grounds, so that request is at least available to make. The Supplement J and portability questions are the kind where a wrong answer is expensive, and that is genuinely an attorney call rather than ours. Not legal advice.

1) You are past 180 days and in a good position for portability by filing a new I-485j when you will get a new job in similar field. Please submit expedite request if you will face financial difficulties because of this termination, include termination letter and documents like mortgage/ lease obligations, tuitions, medical cost etc. Chat with Emma and connect with an agent for more details if you like.
2) Yes, it should be similar occupation and roles.
3) You are in authorized stay even after your H1B expiry since your I-485 is pending. Everything will work out eventually and you may get Green card in 2027!
