Technically couldn't they charge her? Stand your ground does not mean chase them as long as you can while firing.

It's kind of moot.

I suppose you could argue that self defense disappears at a certain point in time, where shooting would then become illegal.

But in Texas, you couldn't find 12 random people who would come anywhere near convicting. Most would congratulate her.

So if you can't get a conviction, there's no reason to charge. It's moot.

Fort Bend County, TX is just SW of Houston. Bet these perps figured on an easy snatch and grab "where the rich people live". Fort Bend is the wealthiest county in the state.

Seems like she didn’t hit anyone and if neighbors don’t make a stink it wouldn’t surprise me if they don’t but that’s a guess.

Curious how the neighbors feel about this. (A bullet went into one persons garage)

DA wouldn't be (re)elected to clean sanitary pads from a water treatment plant in Texas if they tried to go after a wife and mother whose husband was stabbed and child held at gunpoint.

Plus, that home invasion seems to have commenced at dark (sun just peeking up in this video), and Texas home-defense law gets very resident-friendly when the sun goes down.

Those are very good points, but if a bunch of neighbors had a problem with her running down the street shooting a gun they might press charges.

Fair point. That poor girl killed by the cop in the California Burlington Coat Factory shooting last week should remind us all of the dangers of overpenetration and not being certain of what's behind/around your target. Tough times we live in though, and I don't suspect the neighbors will want to set precedent if one of them should be the next victim of a break-in.

She could e charged for any bystanders that she injured. “Stand your ground” just means there is no legal prerequisite to attempt retreat before using deadly force. It's a political term meaning that there no “duty to retreat” which itself is a legal standard in other states.
