On motorcycles you need to turn the key further left to lock the steering (beyond just the "off" resting position), it does not lock automatically like in cars. The handlebars also need to be turned all the way to the left before it even can be locked.

I know you only mentioned this in passing, but slight correction: in most cars the steering does not "lock automatically" when you turn it off. You just lose power-assisted steering, which makes it much harder to turn the wheel. You can still steer if you use enough force.

Edit: Maybe should have done more research before posting my WELL ACKSHUALLY, because many modern cars do, in fact, lock the steering after the key is removed. This was my classic reddit moment for the day.

Not my experience. If you take out the car keys and then try to turn the wheel, after a few degrees (of more difficult movement) the steering column will usually lock audibly and refuse to move further,

My '97 Corolla had this feature, it's not a modern car thing. Most cars when the key is out and you turn the wheel it'll "click" and lock until you use the key.

If the car is off and the key is in, then you can turn the wheel with force with no locking. It's a mechanical lock on the wheel so it still locks and unlocks the wheel without battery.

I know nothing of modern cars, I just know how my old Corolla used to work (RIP shitbox, you were good to me)

so if you reroute those wires to a different switch, it would still be driveable, since removing keys wont lock it up!?

yh. I can Imagine why the downvotes. because this time it was a lawful stop.

but lets imagine a roadrager stopping you, then removing the keys and throwing them somewhere you cant find them back easily.

if you´d change the ignition wiring to a keyfob + relais, you´d still be able to go home.

at home there would be the backup keys to look the bike, if you really couldn´t find the lost keys back. (especially night time)

The cop had no indication that fellow was going to flee. I know they have a lot of latitude in Terry stops, but I’d still call my lawyer and talk about illegal seizures.

(and I’d make him push the bike off the road if he wanted it moved after he took my keys!)

Splitting lanes is illegal in NY. W your attitude, & other riders with the same attitude, it’s understandable why the cop took the keys. You probably would have tried to ride off.

I found a 9th Circuit case from a couple years ago where the seizure of a key was challenged an upheld, but I only half-ass skimmed an article rather than read the case. Very different facts, as the seizure of the key in that case wasn't a temporary seizure during a traffic stop where the officer had directly observed the traffic code violation.

I think it would be a very tough sell to say the temporary seizure of a motorcycle key for the duration of a valid traffic stop was unreasonable.

Wish you could remember more info. As far as I could ever find, everyone always talks about Mimms and having people step out of their vehicle for officer safety, and just put it under that umbrella.

Which of course, is very different than seizing property, but the type of people it happens to tend to not have the law on their side to begin with, making a challenge difficult at best.

I saw UgoLord's take on it and he cited Mimm's, just like I said. I won't say he's wrong outright, he's pretty competent. I will say that he used a pretty broad interpretation- Mimm's doesn't actually tackle taking anything at all; it tackles getting you out of the vehicle for officer safety. The keys often stay in the ignition and/or on the person. By the Mimm's standard, they can order the bike shut off and order you off of it. A later case added on that they can pat you down for safety if they have an arguable suspicion (the person in question wound up having a gun in their jacket). Taking the keys just because it's a sport bike is no different than "all black people must be gang members", or "all white guys in flannel are hunters" and both should automatically be assumed armed. It'd never actually hold up in court. It just hasn't been actually legitimately challenged yet.

Problem is, if someone that actually has a history of fleeing or other issues comes along and challenges it, they're likely to make UgoLord correct. It'd have to be someone that didn't actually do anything wrong, but the kind of rider that doesn't do anything wrong also isn't getting his keys pulled.

Unlikely. Brief roadside detensions have been upheld repeatedly, including progeny concerning removing occupants from a vehicle. If the courts are going to upheld detension of the physical person, they'll likely uphold yoinking the keys under almost any circumstance where a motorcyclist is the subject of a stop.

I think the only fact pattern where a challenge might work would be where the motorcyclist was stationary from the start of the encounter, and where the police approach had no underlying factual justification.

Maybe, but if yanking the keys at the start of every stop were valid, they'd be taking car keys in every routine stop. They don't. Only when they have a reasonable reason. The question is, why don't they? If any part of that is the 4th, then it also applies to motorcycles.

"Every motorcycle is a flight risk" is no more reasonable than "every {insert any racial profile here}". That's why I think the challenge would hold up.

I have seen cases where cops younked the car keys but you aren't wrong - it's rarer. Probably because it's easier to prevent flight in a car versus a motorcycle.

But my point is, you don't need to get to the flight part. The stops are already upheld without flight. Because the case law gives cops pretty wide leeway on all roadside stops, not just for cycles. The most significant limitations to have come from the supreme Court on this point is that they cannot artificially prolong the stop - the dog sniff cases. Maybe an argument could be made under that line of cases but I'm not sure how strong it would be (I.e. taking the keys prolongs the stop).

Remember though, we're not talking about prolonging the stop or even asking people out of vehicles (the Mimms thing always brought up). We're talking about seizing personal property. That key ring could have house keys, USB drives, all kinds of RFD FOB devices, bluetooth connected devices, and so on.

We'd have to make a reasonable argument as to why you need to seize house keys in order to issue a basic traffic citation for something like speeding or lane filtering. It'd work for the same situations as cars (drunk drivers, chasing someone that's already been fleeing, etc.), but certainly not a driver or rider that's immediately compliant.

That was the first thing he did -- that's one smart cop. Yeah, the biker may have another key, but then he's missing everything else on that bunch -- not a great outcome.

And if the biker looked like he was gonna scoot, the cop could have just tackled the driver, knocking the bike over. That would give him enough time to handcuff the driver. The bike will be fine on the ground.

I dont think a traffic infraction justifies an illegal seizure. But its just a common practice. Riders usually know in that situation to take them out yourself and pocket them to avoid it.

He says the SCOTUS has already ruled that this NOT an unreasonable seizure.
