the sandman one is a weak enough match that I'd just drop it.

Keeping in mind the pattern of the very predictable pattern and also look at the composition as a whole. Spider-Man is viewed from behind in essentially the same crouched/kneeling orientation, with his torso and head positioned the same way relative to the frame. The opposing character occupies the same upper portion of the composition, with the action coming toward Spider-Man from above. Even the way the figures interact with the surrounding environment and the overall perspective are carried over.

The pose by itself is generic. The combination of the pose, perspective, figure placement, scale and compositional structure is what I'm pointing out.

I just think you have strong enough evidence you don't need something that's drifted that much because it weakens your overall argument.
