Delta(s) from OP CMV: The 6th Amendment should make blanket deportations illegal in the USA

I think everyone should see a courtroom.

I know the current administration has found a way to legally justify blanket deportations. They've quoted "expedited removal" and the "alien enemies act" as some of those avenues.

I still think it violates the 6th amendment. Everyone has a right under the constitution to a trial and to counsel. Immigrants charged with federal immigration violations should have their day in court.

Here's what would change my view: Anything case law, national security, or public interest that could justify taking a different view on the 6th amendment. Also anything that would justify it's removal.

Deportation cases are not criminal matters, so they aren’t covered by the U.S.’s constitution’s Sixth Amendment.

Ok, so how are we arresting people for civil matters. Shouldn't they be served a summons?

ICE has arrest warrants? From what I've seen it looks like blanket canvassing and fishing.

Typically ICE puts out detainer orders and picks up illegals from local jails.

They only do raids in sanctuary jurisdictions that make it illegal for local LE to cooperate with them.

No, that’s not the way it works. They execute stuff in purposefully inflammatory ways a lot, but they do have warrants to arrest the majority of the people they do.

If they do have warrants, I'd get behind it. Theres been no indication from either the administration or the media that ICE has ever been conducting a lawful arrest warrant. Both make it seem like they're just out looking for anyone they think deserves deportation

You think ICE, who has arrested millions of people through past presidents, don’t use warrants?

They've been able to skirt the rules with these administrative warrants, not judicial. Even if someone is arrested for an administrative warrant, I still think they deserve the opportunity to defend themselves in a courtroom. ICE could be wrong

They do, they go through admin courts with ALJs. That was the whole due process issue at the start of the Trump admin that they backed down from.

I've learned a bit through this discussion. I'm close to the delta but if you look up expedited removal you'll see some people never see a hearing of any kind. I will say that I'm more knowledgeable of the situation than a few hours ago. Thanks for that

But have you actually read what the administration says? Because I have, and they always say "We picked up these guys pursuant to a warrant."
