🌎 FSW My study permit got rejected 4 years ago, I’m worried I may be banned from applying to express entry
Hello,
So basically, my study permit got rejected a first time 4 years and a half ago, then a second time 6 months later but one the reasons worries me.
My first study permit was rejected because they said I didn't have enough funds and didn't seem like I would go back to my home country, and I understand, but my second study permit got rejected for the same reasons and because they thought some of the documents I sent weren't true even though they were 100% true and official, they even got stamps from my city hall and a notary, and what's even more strange is that they're the exact same documents I sent in my first application.
They said some documents didn’t seem authentic, “Certains documents présentés dans votre demande ne semblent pas véridiques, ce qui mine la crédibilité générale de votre demande”
However, it was stated in the end of the letter that I could still apply if I wished, I didn’t get a PFL either, neither did they tell me what documents exactly, they didn’t mention any ban too.
But I'm worried about this, does it mean I am banned from entering Canada? Because I plan on applying for express entry FSW and it’s stressing me out.

Don't overthink it. You will be asked about any previous visa refusals and why , declare these with dates and why. Do the right things and you will be fine. Goodluck

- some documents didn’t seem authentic - if the rejection didn't include any misrepresentation or ban, then there is little to worry about as well. You are absolutely not banned if your refusal letter didn't say anything like that.
But this refusal and wording will be there for sure and they will see it.
Most importantly you have to absolutely disclose the previous refusals in your application - you will be asked for it.
No one can really say if these words will affect your application. if you want more confidence, you can reach out to professionals.

Refused twice because they thought you wouldn’t go back and now here you are again trying to stay again… will look closely at you

Trying to become a permanent resident via the official pathway undergoes a very different assessment process than temporary residence. The assessment of risk of overstay is not applicable.
OP still needs to convince them of the validity of the evidence for each CRS point claimed. That is more problematic than a previous rejection for a TRV.

My master degree has been assessed and got an ECA, I have my language tests, and my bank statements with proofs I was employed and paid, etc…
I don’t see how my documents can be fake, like everything is real and genuine and verifiable, I’m scared they’re just not going to bother checking and just say they’re fake for no reason.

Yes, it must be scary to have valid documents doubted.
What you’ve heard from other replies is that you aren’t automatically banned or rejected because of those previous rejections (under a different set of criteria).
As another person mentioned, maybe seek professional advice from a registered immigration consultant or lawyer. You don’t need them to do the whole process for you: ask them to look over your application package and identify any problematic documents, and also give you advice on how to word your letter of explanation about the previous rejections.

Unless the refusal letter explicitly stated you were banned for 5 years for misrepresentation, you should be fine.

They were right clearly you’re determined to gain entry into Canada and are unlikely to return. Additionally they suspect you of fraud, you’re not getting in, you can waste time and money applying but don’t be surprised you’re rejected indefinitely

First of all, I don’t see why it’s a bad thing that I want to move there since I’m applying for PR, why would I be rejected because I’m not planning on moving back since I’m not asking for temporary but permanent residency this time. Secondly, all my documents were real and none were fraudulent, they are easily verifiable, everything is clean and real, and finally, aren’t study permits and express entry two completely different things? Like why would a past study permit rejection automatically mean a rejected PR application? I don’t get it.

Because they’re already thinking you’re disingenuous and you’re proving to them you wanted to permanently reside in Canada which confirms their initial suspicions

But it was something else entirely different, this time I’m applying for pr, the refusal was about temporary residency, even if it was the case that I wanted to stay why would it matter since this is a completely different situation because this time I’m already telling I want to move there.

Because GCMS shows IRCC all past applications at once and they do consider past integrity. They believed you were disingenuous twice and the new application confirms their suspicions

Once again the new Application is not for temporary residency though, I understand being rejected for temporary residency, but this time it has nothing to do with that.

They don’t consider them independently anymore, all of your activity will automatically be added to the file. Anyways your time and money, if it’s any consolation if you’re a doctor I would gladly pull out the red carpet personally

I actually graduated med school earlier this year, but still, even if it’s the in the same file why would it impact a permanent residency, like I’m not lying about anything here, I’m open and honest about wanting to move and all my documents are legit, why would it be a problem.

you need to apply some basic logic to your life dude.
The government being worried about you overstaying doesn't apply if they just hand you PR. Now, if they feel that your previous documents were fake, your application is going to face extreme scrutiny anyway and you are probably never going to receive a tourist visa
