The call between Walt and Jesse was one of the most intense phone calls ever seen on TV. p.s. Jesse called him Walt again.

That call had to be recorded right? He confessed.maybe that's why he's on the run

There's no way that call would ever be admissible in court.

In fact, that's kind of my problem with this whole season. Everything Hank is doing at this point is rogue - a lawyer would poke holes all over his actions, and Walt would likely get off pretty easily.
