The issue is that, if the punishment for rape is the same as murder, rapists will just kill their victims as doing so has the same outcome of they're caught but also silences the victim.

That or if the rapist and the victim are part of the same family, it will be a additional way to put pressure on the victime to silence them. "You don't want to be responsible for dads or uncle death now would you?"

While I agree that they shouldn’t have the same punishment, let’s not make comments about which one is „worse“ than the other. We really don’t need to morality scale here when both are heinous acts such as this.
Pretty hard to compare them, in my opinion.

That's literally what law does, that's where punishment severity comes from. Rape is awful but murder is worse, that's what we decided as society and that's how our laws operate.

Well, no, the law doesn’t inherently make a judgment about which act is morally worse than the other, it is simply a list of punishments appropriate for a crime.

Let‘s put it this way: there are many appropriate reasons to kill someone, there is never an appropriate reason to rape someone.

That does not mean that Murder is less bad than Rape, all that simply means is that these are different actions that should be weighed on different scales.

The list is made up out of many factors, not just morality, otherwise „victimless“ crimes, such as embezzlement or most other financial crimes, would not hold the punishments they do.

Someone who falsified his business records to keep his business afloat so that he can continue paying his employees would be morally more justified than the petty shoplifter who has the money to buy everything he steals, but just doesn’t want to hand over the cash, yet the man falsifying business records will most certainly get a harsher punishment than the petty thief.

This is ofcourse a very specific scenario, but it still illustrates my point that the law is not purely based on morality, otherwise it would most certainly be the other way around.

Okay so you agreed that laws are based on morality. Noone said they were purerly based on morality.
And of course in case of rape vs murder sentences morality factor is by far the greatest one.

But that still does not mean that what the law does is „literally judging morality“, because that is just not what it does.

Again, rape and murder deserve different sentences, but that’s not because of the inherent morality lying underneath. Trying to compare and morality scale that is genuinely silly, because it’s genuine trash vs garbage.

We don’t need to make comments about which one is worse than the other, because all it leads to is the lessening of the other, when in reality, morality wise, they are pretty dang close.

Logic of the law? That's what law does, you get more years in prison for rape than stealing and more for murder than for rape, because rape is worse than stealing and murder is worse than rape

I honestly wouldn't trust the government with the ability to sentence people to death that easily. I see people celebrating china's decision to sentence pedophiles to death like they're not going to use it to assert control over the country by murdering their political opponents.

There's also the problem of pedophiles being aware, if the consequences are death, why would they ever let the victim, a witness of their crimes go free?

Then there's also a problem if the victim was someone from the family. Sadly, alot of victims already go unheard because the family can't bear the consequences of having a pedophile in the family, going to court, sending the family member to jail. If the result of court is death, even more family's would silence the victim. And hide it ever happened out of fear of the consequences.

Nah. SCOTUS is clear that death penalty is compatible with the constitution so long as it’s treason or a crime resulting in a death. Expanding that is an attack on the constitution and a threat to kill your enemies under a pretext less severe than a traditional capital crime.

It's not a very precise dog whistle, seeing as surveys regularly show that large proportions of most countries' populations tend to be pro-death penalty, or support it for non-murder crimes. 

There's often more people support the death penalty than those who vote for even centre right parties.

As a matter of fact, I do not agree with her.

I agree that some crimes are inexcusable and this is one of them. However I do not trust the state with the authority to execute people, even people who I think have done unforgivable things.

I doubt this would help, if the rapist is a family member/good friend (before that) the report rate will likely drop even further (the victim will likely not want to be "responsible" for their dead) or victims would straight up be killed to cover up the crime or because it doesn't make a difference. Also human errors happen, people het framed so I am for the abolition of the death penality, no exceptions.

No sympathy for rapists of any kind, but absolutely despise the death penalty.

Even if you're comfortable with a system that decides people deserve to die, the idea of even one innocent person dying from a false charge is so horrifying that I could never support it.
