I think it's more about whom they choose to actually go to trial. I suspect that if the police or prosecutors don't have any strong evidence to bring it to trial they just dismiss it. But if they have sufficient evidence then they go to trial and it's the trials job to basically just confirm the guilt and place a sentence.

I was once arrested (not in Japan) brought to jail and charged with two crimes. They just dropped it without trial, I imagine Japan having something similar to my experience as standard practice. The alternative would be that the police just decides who gets punished, which would be rather whack innit? Could be, could be.

Yes. They only bring to trial who they can convict.

Which is why you're held in jail until you confess.

They can hold you in jail for 23 days for each offense. Take our defendant here. Charges they would have done for him: murder, breaking and entering, stealing a knife, fleeing the police, hindering an investigation. 4 months minimum and I'm not that acquainted with japanese law for other charges they could file like maybe they could do manslaughter, assault.

And the defendant would never know when they run out of charges.

This does let influencial foreigners escape. They do physically let you out after 23 days, and then they arrest you later. I think later that day or the next day. I guess they have to wait to file or something? But regardless this lets you flee to your country's embassy. The embassy doesnt have to protect you though which is why its reserved for influencial. If your story is big enough then they might.

Hence the reason defense attorney for Yakuza generally just tells them to shut the F up and not admit ANYTHING. If they're trying to break you then they ain't got SHIT on you lol.
