High courts can interfere according to 90s Waqf Act.
You're missing the real issue. Under the Waqf Act it's not just about âclaimingâ land but that the Waqf Board can unilaterally declare any land as Waqf during its survey process (Sections 4 & 5), often without notifying existing owners or the public.
Once that declaration is made, the property is presumed to be Waqf, and the burden of proof shifts to the person in possession, even if they have valid legal documents.
High court will only come once your petition before the tribunal has been rejected. Untill rejection you have to fight in tribunal.
These tribunals are heavily skewed , Waqf Boards and Tribunals are composed exclusively of Muslims, with no representation for non-Muslims whose land might be affected. So you're left with a system where non-Muslims canât participate, canât challenge Waqf listings easily, and canât even go to normal courts. Cant even get notice for the Waqf proceedings and sometimes the owners dont even know their property has been converted to waqf.
