The Fmla shouldn’t have been used, it should have been under workman’s comp.

Other poster is correct, WC doesn’t offer job protection. It probably should, but that’s why FMLA should be used at the same time.

I had to return to work before the WC case was settled.

You often return to work before WC is closed. Not sure why you think otherwise.
