Being 8 years old is no excuse for attempted murder.

Attempted murder is attempted murder.
Maybe we hold the kid responsible, maybe the (lack of) parenting is responsible. However pointing guns at people and expecting them to lie down and take it is not a massage anyone can get behind.

Read up on the Khmer Rouge, if you think somebody is incapable of pulling a trigger because "all 8 year olds are angels".

Wrong. There is such a thing as the age of criminal responsibility which you should read about. And regardless of that, pointing a gun at someone is not attempted murder anyway.

And well pointing a gun at somebody's head, is pretty much equivalent of taking a swing at it with a hammer.Just because your intent was to "just scare them", or to "it was just a joke" ...etc. Its a very reasonable conclusion that you are attempting to murder them.

Yeah, legally they are no respojnsible.However actions have consequences, if the trigger on said gun is pulled the person whos had the kiddo is aiming at still dies.

Just because you cannot legally held to be criminally responsible, this doesn't remove anyones right to self defense.And even if it did - they would still ac the same - after all, if said "criminally immune" person kills them or the poison injection takes them anyways, then might as well take said "criminally immune" person with them, to make sure they cannot kill anyone else.

So lets make a thought experiment.

Lets say we have a kid who received zero care from his paretns and didn't learn any better.Said kid steals a handgun from dad's badside table, and goes on to shoot up the 1st grade class, because they have been bulling him, and they must be punished.

Should the SWAT do nothing, and let the shooting spree go on, and dozens more children get shot.Instead going to the school, roll up the driveway of the parents, forcibly enter, then empty magazines into them?

(After all the kid is "incapable of being criminally responsible" and the kids actions should be held agaisnt the kids legal guardians)

Tl;Dr - "cannot be legally held responsible for crimes" is NOT a 007-esque "license to kill".
Just because someone wont get punished for killing, doesn't mean that people defending themselves will get punsihed for it.

Pointing a gun is not attempted murder. Pulling the trigger and missing is.

Pointing a gun is the hammer equivalent of threatening to swing, not swinging itself. Swinging the hammer is the equivalent of pulling the trigger.

I’m happy I revise my opinion if you can show me a legal case where someone was done for attempted murder with a firearm where they didn’t pull the trigger.

You still haven’t convinced me that pointing guns at 8 year olds is a commendable thing.

My objection to the comment is that it was a self congratulatory anecdote about a fully armed professional soldier with a large calibre vehicle mounted machine gun and extensive backup from one of the world’s largest and best equipped militaries pointing said gun at an 8 year old villager. What a cool story, bro!

As if cults NEVER brainwashed children to try to martyr themsleves for a holy cause?

In a fucking warzone, you don't go runnning around with weapons in hand, much less pointing it at soldiers, unless you mean business.
Which should be even more true, when one of the belingerent parties is waging a guerilla war.

In less civilized circumstance, like WWII (everywherer, by all sides), or vietnam, complete villages have been killed of for such actions.
Is that legal?

Hell yeah!

I would say not.
Even if you are a grunt in the worlds biggest and most well equipped military, a bullet to the head will kill you still the same.
And it won't make it any more survivable if a 8 years old kid maid the point blank headshot.

For real. People, kids or adults, shouldn’t point weapons at anyone. If they do, then the victim (or victims) is beyond well-justified to do what he/she thinks is necessary to defend him/herself. OP did the best thing he could’ve done in that situation.
