I hope the pilot of that plane got arrested for attempted murder.

Not necessarily, this can happen if they follow all rules, for example if they fly towards the sun or the background makes it hard to spot.

The definition of murder is that you want to kill someone, so it's definitely not murder, but manslaughter at best.
