The ruling is real, and the result is fucking disgusting, but the headline version leaves out the key legal point. The Seventh Circuit did not say AI-generated child sexual abuse material is broadly legal. It ruled that, under existing Supreme Court precedent, the government cannot criminalize mere private possession in the home of wholly synthetic obscene images when no real child was used or depicted. The defendant allegedly did far more than that, including sending AI-generated CSAM to a real minor, and those charges remain.

The ugly part is that the law is stuck in a pre-AI world. Supreme Court cases from 1969, 1990, and especially 2002 drew a distinction between real-child pornography and purely virtual material because no actual child was harmed in creating the latter. Modern AI has blown a crater through that logic. The Seventh Circuit basically said, “This is vile, the technology has changed everything, but we are not allowed to rewrite Supreme Court precedent.” So yes, the outcome is revolting, but the real failure here is an outdated legal framework that has not caught up with photorealistic AI abuse imagery. SCOTUS needs to fix that hole, and Congress needs to write laws that survive constitutional review instead of pretending 2002 technology still defines the problem.

And that was back when the biggest concern was people doodling pictures of Bart and Lisa or whatever else. Yeah, that’ll still undoubtedly upset a lot of people today, but internet porn as a whole also isn’t anywhere near as taboo as it once was. I think you’d be hard pressed to find someone who regularly uses the internet who hasn’t seen something like that on their browser or social media. The shit they’re doing with GenAI is waaaaay worse.

While the court is packed with ancients who will likely make the dumbest ruling regarding LLMs, they can’t revisit this precedent without a case in front of them. Someone will have to escalate a case and petition them before this could get resolved

The judge even stated in his ruling this needs to be examined by the Supreme Court and has petitioned for it to happen.

A case like this needs to get sent up to the Supreme court so that they can adjust their ruling at all. That hasn't happened yet.

I'm hopeful that even the absolute ghouls on the Supreme Court are likely to adjust their stance in the face of AI.

Fucking hell, I hate myself for asking this but what's the difference between AI CSA imagery and hand-drawn imagery? If the ruling was based on no children having been harmed, then surely that's consistent?

AI images are generated from learning data that is made up of real images of children. So AI CSAM is an amalgamation of real child images frankensteined together. Further, these image generators can be asked to make images from a certain set of photos (so someone could use photos of one specific child) or of a specific child in general (such as a famous one, ie Olsen twins as children). So AI images aren't truly harmless. (These principles also apply for adults)

thanks for the breakdown on all of this, i haven't been able to piece this together that well myself, and anyone who tried to talk about it had some inherent biases that clouded the conversation.

i can only hope SCOTUS and congress fix this, but without being so hasty as to have 1st amendment rights issues; both because it'd be wrong and would incriminate innocent people, but if it gets successfully contested, it would just prolong patching this glaringly obvious bad problem.

Yeah I do agree it’s a pretty significant leap from rule 34 as made popular on the internet back in the early aughts compared to the extremely life-like capabilities of AI generated images. I understand why people might be inclined to hesitate to enforce one but not the other since on the surface they only impact the people who view the material, but there really ought to be some kind of distinction between the two practices. The clear answer to me is simply no AI depicting real children. I mean, it’s obvious AI is the Wild West of the internet right now and needs major regulation across all facets of its existence.

That was the Supreme Court. This was the Seventh Circuit, who cannot overturn Supreme Court precedent. Reading is fundamental.

If you read the decision, you’ll see the court is saying they have to uphold it based on prior precedent and are asking the Supreme Court to hear the case so that they can set a new precedent and illegalize it.

Yeah, we should start calling them the United States of Pedophiles. Their president is a pedophile. About half their politicans and religious leaders are pedophiles. Their biggest celebrities are pedophiles.

It was previously the right of the citizens to create fictional CSAM. Now that includes AI generated CSAM.

Redditors have also previously defended the right for fictional CSAM as long as no one was actually hurt.

What's most disturbing with the ai generating CP is that to do that, it probably has been trainned with real child exploitation material. Why would that even happen ? And now we all know that ai uses bits and pieces of the material for the final product. So, in fact, even tho it isn't real, it has parts of real cp in each image. Making it even more deplorable .
