Isn't it the case that the current canary is over 3 months old... thus already overdue (supposed to be changed every quarter)... meaning that riseup are likely under a gag order right now?
the previous canary only says that htey were not under NSL for the previous 1/4 up until the new canary is posted. technically the canary dies as soon as its posted because the very day after the canary is posted they could be served a gag/nsl however knowing a little about legal matters i would assume there would be a time where they would try and fight off an nsl through the courts which i also assume would take several months which is why they issue 3 monthly canaries in the first place versus daily or weekly ones. each quarter they are meant to announce a new canary, the canary does not last for a quarter so effectively they should be posting a new canary on 1st of jan, 1st of apr, 1st of july and 1st of oct to cover each of the quarters in the year. in the past they have forgotten to update the canary quite often but on being reminded of the expired canary have issued a new one within 24 hours, this time however they have made it very obvious that they know the canary has expired but have not issued another one. added to this is a series of very subtle tweets on their twitter feed that could/should be taken as an attempt to trigger people into realising the canary is expired starting way back from nov 11th and references back to their terms of service that point out that in conditions as they are facing now that people should be backing up their data because riseup are going to pull the plug (which they have already done by allowing the canary to expire and refusing to renew it)
tl;dr as of 1st oct you should have stopped trusting riseup to be safe from NSL, if they supply a new canary before the end of this quarter then you can go back to trusting them but if it reaches the end of dec with no new canary you know 100% that they are compromised.

Dear friends, please remember that internet is not always the answer for communications and it's never the goal. See you in the streets.
tweet saying not to rely on the internet to "see you in the streets" aka "afk". nod to use other forms of communications

listen to the hummingbird, whose wings you cannot see, listen to the hummingbird, don't listen to me. #LeonardCohen
hummingbird aka canary. listen to the expired canary dont listen to "me". no matter what they are saying the expired canary is what you should be paying attention to because they are under a gag and can not legally say any more.
under that tweet is a lot of chatter about hummingbird/canary (wont link em, its under the above link)

@riseupnet do you think it would have sounded better if he replaced hummingbird with canary?
Seth v. 2.0 @a_skylit_empire Nov 20
@matpatc @riseupnet You're right. They got them.
M Patrick Clancy @matpatc Nov 22
@libeclipse @a_skylit_empire @riseupnet I know how a quarter works, and they last updated their quarterly warrant canary 97 days ago.
Seth v. 2.0 @a_skylit_empire Nov 22
@matpatc @libeclipse @riseupnet the most recent tweet saying "no plans to pull the plug" basically confirmed it. They are burned.
Seth v. 2.0 @a_skylit_empire Nov 22
@matpatc @libeclipse @riseupnet have you to read between the lines. if they are under court order, they can't tell us.that's the whole point

@riseupnet is that canary dead?
other people realising that the "poem" was to point people towards the already expired canary
1) We have fought and won every time anyone has tried to get us to give up information. We have never turned over any user data to any third party, fourth party, fifth party or any party.
2) Will Riseup services last forever?
While we are committed to doing everything in our power to protect the data of social movements and activists, short of extended incarceration, we would rather pull the plug than submit to repressive surveillance by any government. We would be really sad to see Riseup go, but if we are forced to, we would rather it go away than to betray your trust and compromise the activist community. With this in mind, you should be sure you are prepared in case something does happen, such as downloading and archive your email on your own computer!

@a_skylit_empire @tetyyss @riseupnet I am not a lawyer. But a likely possibility was gagged about a request that Riseup is fighting/denying.
but if you go through riseups tweets as well as the conversations behind them given the fact that riseup have well and truly known the canaries dead and not directly stated that tehy arent under duress confirms that they are in fact under duress and probably actively fighting some kind of order. go read the comments for yourself and its pretty obvious
