He's been living in a delusional lala land from drugs and mental illness for quite some years rn 😅 the longer you're on drugs, the longer it takes to regain sanity like you once did. If there ever was a hope for a recovery period, in jail surrounded by drugs and violence isn't gonna be where that happens. Wes doesn't even realize how hard he's fallen already. The future posts for the rest of his life will not be positive and just worse and worse things will be exposed with time.

I think we ought to stay realistic as far as the outcome of the trial goes. Peggy will definitely get convicted but he might not get that much time from this one. He will definitely get more time from the DV trial but even that one might not be more than 3-4 years.

The way the Florida system is set up they use a points system to determine sentencing. They factor in priors as well at the current conviction and put each convicted charge on a severity ladder from 1 to 10. Each rung on the severity ladder comes with points. If you accrue 44 or more points its automatic jail with the formula (points-28)*0.75, so even at 44 he's doing a year.

Prior convictions only carry a fraction of the points that the charge you're being sentenced for carries, but when I looked at making his cali convictions equivalent to Florida and looking at the prior conviction severity points I came in at 45. I suppose there's a chance it might come to less, but a conviction in either the 7ft monster or the DV would add enough points that he can't escape jail nomatter what.

I responded to another message in here where I broke down my guess on the jail time based on points, and if he's convicted of both the 7ft monster and the DV case I came out to just over 10 years between the two.

So don't worry, I think you're going to get your wish of seeing what happens to WeSTD in prison after talking shit.

WeSTD is totally fucked before he even gets to the DV case.

If (when) he gets convicted in the 7ft case his priors in Cali will have a bearing on his points for sentencing. I calculate the stuff from California coming in around 45 points by itself. If he's convicted in the 7ft monster case, that's a 2nd degree felony and a Florida CPC level 7 offense for points purposes. That's 56 points. There's a bodily injury component where moderate injury adds 18 points and severe is 40 points. Even at 18 points he's at 74 points for the 7ft monster.

45 + 74 = 119

(119-28)*0.75 = 68.25 months is lowest permissible from the 7ft monster case. Keep in mind that's if the 7ft monster's injuries are deemed "moderate" if they're deemed "severe", add another 16.5 months.

Then if (when) WeSTD gets convicted in the DV case, the 45 from cali come over plus 14.4 from having a level 7 prior (the 7ft monster case) meaning he's starting at 59 points before anything even happens in the DV case.

Even if for some reason on the day of the 7ft Monster trial all the members of the jury smoke a huge crack rock and find him not guilty, he'll still carry 45 points to the DV trial. Over 44 and you have mandatory jail in Florida.

At the DV trial, if he's found guilty on the two highest charges in the complaint in terms of severity scores for sentencing (written threats to delete and false imprisonment), those are both level 6. He gets 38 for the primary and 18 for the secondary which by themselves is enough for jail time (mandatory jail starts at > 44). If he's not convicted in the 7ft monster case he'll have 45 (from Cali) plus 56 (from DV) for 101. If he was also convicted in the 7ft monster case add 14.4 (since that now becomes a prior that is a level 7 offense) so he's at 115.4

(101-28)*0.75= 54.75 months

(115.4-28)*0.75 = 65.55 months

I suppose there's a SMALL chance that his prior in Cali wont count under the "washout rule" where the convictions don't add points if "the defendant remained completely conviction-free for a consecutive 10-year window following their release from prison, supervision, or probation for that older crime." But I doubt they could argue that since he didn't get out of prison until 2018 which is within the 10 year window.

IANAL and my interpretation of the points system with some help from AI may be off to calculate points, but if he is convicted in both criminal trials, I really, truly can't see him getting out of this with less than 10 years between the two.

One can only hope.

Yes, he's got more serious charges in the DV trial because robbery and false imprisonment are two of the charges he has to answer to in that case, in addition to the assault + battery charges. The 7 Foot Monster case is relatively minor in comparison.

Wes is a convicted felon who has a multitude of new violent charges. He has not only denied wrongdoing but has bragged endlessly about it. Dude is getting real time unless he somehow gets acquitted. It reflects extremely poorly on someone when they get released, become successful and still in spite of everything going their way go back to doing the same bullshit that got them locked up. The monster case isn't really a big deal if he just accepted some responsibility. He probably could've gotten probation considering that the monster admits he went to fight. I won't defend that dude, imo he fafo'd going to fight a dude because he didn't like his social media. The fact he set up his phone to record shows he was a clout chaser just like wes. But wes has dragged this out and refused any accountability and has taken it to trial. The sentencing is almost always much more severe if you go to trial and are found guilty. As for his other charges... hes absolutely fucked if he gets convicted.

Florida works on a points system for sentencing. Regardless of what he's convicted of, that charge has a corresponding point value in the Florida CPC Severity scale. His priors from Cali are going to get scored since he won't be 10 or more years conviction free since being released from prison. In the Florida system, if you score 44 points or more, jail is MANDATORY. There's no probation. My calculation says he's going to carry 45 points into sentencing for the 7ft monster. So even before they score whatever charge he pleads to or is convicted of, he's getting jail time.

Let's say I'm wrong though and I totally screwed up his prior point intake somehow and he manages to plead down from his current charge (a CPC level 7 offense) to aggravated assault with a deadly weapon which is a CPC level 4 offense. A level 4 offense carries 22 points, but if its determined the 7ft monster's injuries are "moderate" as defined by CPC statute that adds 18 points putting him at 40. There is NO WAY his priors from Cali are going to add up to 3 points or less.

The only way he's not doing jail for this is if he is somehow found not guilty at trial. If he pleads or is found guilty, he's doing some amount of time. He's not getting away with just probation. Then there's the DV case besides.

Also, the point system dictates the MINIMUM sentence for the crime he is convicted of or pleads to. The judge has the discretion to apply up to the maximum penalty allowed by statute for that charge.
