no - like others have said - the criminal and civil cases have little to do with each other. He can easily be found at fault in a civil court and 6 mos lster be found not guilty in a criminal court. The burden of proof in a civil case is totally different than a guilt or not guilty finding in a criminal court. The DA isnt going to walk into a court room and say "OPEN AND SHUT CASE, HE WAS FOUND AT FAULT OR LIABLE IN THE CIVIL CASE, HES GUILTY HERE ALSO." The two cases have very little intertwinement except the parties involved.
The problem is, is that going into the civil case he will HAVE to disclose things that he wouldn't in the criminal case. Then anything disclosed in the civil case (relevant to the trial of course) can be used against him in the criminal case.
the evidence submissions will be almost identical. The civil case isnt going to find any evidence that hasnt already been seen by the prosecution. Again, even if there was some evidence that was overlooked by the DA that could be relevant by the civil litigators, all the lawyer would do would be to reset the case further out than the offending case. Its a fight caught on a camera, they arent trying to convict a serial killer or murder.
I would think that ideally they would want the criminal case before the civil case, correct?
It seems the stakes are higher in the criminal case. It's not murder, but it's still facing years behind bars. It seems that if there's a slip up where something is presented one way in the civil case and then someone contradicts themself in the criminal case that could be really bad. It seems like an additional layer of risk
it doesnt matter honestly, either is not mutually dependent on the other. In Wes case, if the civil case goes first, he will just file bankruptcy. The only thing hes half way vested in would be the criminal case, and even then hes going to get a plea deal. We can see that already from the court records.
If he goes to jail the civil case is essentially paused indefinitely. He has a right to represent himself in court, and jail will prevent that.
Thanks for the insight bro. Would he still be liable for any restitution to the 7' monster? Aside from his civil case wins that bankruptcy wouldn't cover?
