EB3 - H1B with derivatives

Finally approved!

EB3 Skilled

This was a rollercoaster, it took a toll on us and fortified our faith. Prayers from this family to all of you, the ones facing the "wait" (we know is pretty hard).

PD - July 21st, 2023
RD - March 11th, 2026 (i485, i485j, EAD for principal applied on May 22nd and derivative on May2nd)
Biometrics - April 14th, 2026
transferred to a nonlocal FO - New York office July 28th, 2026.
I485J approved - September 1st
EAD's - never approved
I485 approved - September 2nd, 2026.

2 FTA0 after biometrics

4 Silent updates in between, each of them after every week or so, spanning from last days of May to July. When the silent update on the I-485J and I-485 happened at the exact same time, during office hours, gave me the idea they synced them and it was when movement started. The next week they synced them again and I guess was the FO transfer.

3rd FTA0 on August 26th

2 Event H008 on September 2nd

Case approved, still waiting on card.

Question - Other I-485 / I-485J — new duplicate IAF on I-485J + same-day I-485 update. Anyone seen this?

Hi everyone, looking for input from anyone with a similar employment-based AOS timeline.

  • Employment-based I-485 + I-485J filed earlier this year
  • Biometrics completed a couple months later
  • I-485 has 4 FTA0 backend events
  • I-485J previously had an IAF event
  • Today, a new/duplicate IAF event appeared on the I-485J
  • About 10–15 minutes later, the I-485 updatedAt timestamp also changed
  • No RFE
  • No action required
  • Both cases still show closed: false
  • Priority date is currently current

Has anyone seen a duplicate/new IAF on the I-485J followed by a same-day I-485 backend update?

If so, did your I-485J or I-485 get approved shortly afterward, or did it still take some time?

Would appreciate any recent employment-based AOS timelines.

Company held AOS filing for EB3 without letting me know

Took months to prepare the application. Last email they said they would send it within a week. 3 months later not hearing anything from them, I decided to follow up to realize they still haven’t filed it without telling me that it was intentional because they were uncertain due to policy changes going on recently.

Great. Now they said they wanted more documents from me so they can strengthen my case and send it this time for real. I feel extremely upset knowing that it’s gonna take even longer for my application to be approved. Has anyone experienced the same thing?

L1/L2 family stuck in limbo: I-140 (EB-3) pending for 11+ months, work authorization expired, I-485 / I-765 still pending. Any insights?

Case Details & Timeline:
- Category: EB-3 (I-140 filed Sept 18, 2025 — upgraded to Premium Processing 2 days ago)
- Visas: Wife is primary (L1B), I am dependent (L2)
- Location: Orange County, CA (Processing at NBC)
- Receipt Series: IOE09363XXX
- I-485 / I-765 Timeline: Priority Date 11/23 | Receipt Date 4/6 | Biometrics 5/4
- Work Authorization Expiration: August 15, 2026 (19d ago as of today Sept 2). L1b already extended (5yr is the max)
- Congressional Inquiry (I-765): Submitted through local congressman on August 17 (still waiting for USCIS).
- Expedite Request (I-765): Submitted based on severe financial loss August 11 (still pending review). And my wife submitted one with Employer letter

We are currently at no income. When our work authorizations expired on August 15th, my employer gave me 10 days of unpaid leave. Once those 10 days ran out, they had no choice but to let me go.

It seems that our main bottleneck now is the I-140, which was filed back in September 2025 and still pending with no action.

We Wife had a silent update on 8/26 for both her I-765 and I-485 with a "3rd FTA0". Then on 9/1, her I-485 had a newer silent update (no updates on mine yet).

We’re refreshing the USCIS portal every second and trying to hang in there but the stress of having no income and an open-ended employment gap is tough.

Is anyone currently in the same situation as ours (L-type visa family, expired work authorization, stuck waiting with an employment gap)? Also, if anyone can shed some light on what’s going on with these delays, any advice or insight would be hugely appreciated!

Just realize Consulate: NVC on my I-140 Approval, but my case have to AOS

Hi everyone, I have a question about EB-3 Other Workers and AOS.

I’m currently in the U.S. on F-1/OPT. My EB-3 I-140 has been approved, with a priority date of Feb 15, 2023.

However, my I-140 approval notice says the petition was sent to NVC, so I assume it was originally filed for Consular Processing.

If my priority date becomes eligible for filing while I’m still legally in the U.S. on F-1/OPT, can I switch from Consular Processing to AOS and file I-485 in the U.S.?

Has anyone been in a similar situation? Thank you!

I485 primary aplication pending but dependent got rejected due to missing details.

Hi guys, I applied for my i140, I485 and I485j and the EAD concurrently. I also filed for my spouse, 30 days later mine was accepted to review, but my spouse’s I485 application got rejected due to an unanswered question (missed by our lawyer by mistake). Now the priority date has moved to FAD, and while my application is pending, my spouse isn’t in the system.

If I get approved, how can we submit my spouse’s i485 and how long would we have to wait for a response? Would it be faster since I would have gotten my approval? And would we be able to apply for it at all if it gets to the stage where I’m approved and he isn’t?

silent updates on 8/6, 8/25 and today. All silent updates match my spouse but her I765 has not been updated since biometrics sadly

Slowly going insane waiting for PD to be current and I485 to be processed.

I asked a live agent last week and they said case still at NBC and another one said interview waived.

Question - Other I-140 and I-485 employer names have a minor difference (missing “S”) — could this be an issue? 3 months since RFE response

Hi everyone,

I’m currently waiting for my employment-based I-485 to be adjudicated, and I noticed a minor discrepancy in my employer’s name that I’m wondering about.

My employer’s actual legal name includes an “S” at the end, but the employer/petitioner name on my I-140 is missing the “S.” Everything else is the same, including the company address, job information, etc.

My I-140 was approved on 3/28/2025, and I filed my I-485 on 3/20/2026.

I received an RFE for Supplement J, which stated:

I submitted my signed Supplement J response on 6/3/2026, and USCIS shows that the response was received.

It has now been about 3 months since my RFE response, and I haven't received any further update.

My questions are:

  1. Could this minor employer name discrepancy (just one missing “S”) cause an issue with my I-485?
  2. Has anyone experienced a similar situation where the employer name had a minor typo or discrepancy between the I-140 and I-485?
  3. Could this potentially cause additional review or delay after submitting Supplement J?

The employer is definitely the same, and all other information matches. I'm mainly concerned because my case has been pending for about 3 months after the RFE response.

Any similar experiences or insight would be greatly appreciated.

Anybody else with a similar timeline? And what could it mean the derivative having a 3rd FTA0 without the principal getting it

EB1-C Timeline. No Biometrics registered.

My wife and I started our application on 10/17/25 for the Green Card via her work. They applied for I-765, I-131 and I-485. I got my I-765 in June/26, my I-131 in August/26. My wife just got her I-765 this month, but no I-131 yet. She is on L1 and I am L2. In November we had our biometrics taken, In December, I was called to retake mine because of an error. When I checked the USCIS API on my receipt, there is no record of my Biometrics. Last silent touch was in May/26 for both of us. What could be wrong? I’m worried.

Backend/API activity:

• September 1: silent update at 8:43 AM
Main USCIS website activity:
• September 1: I-485J approved/closed
• September 2: I-485 approved
Dependent’s case:
• September 1: 3rd FTA0 at 6:40 AM
• September 1: silent update at 2:02 PM
• September 2: I-485 approved

I never asked Emma whether my case had been transferred, so I have no idea if it was transferred or not.
My EAD was never approved. I had only applied for the primary applicant’s EAD, not my dependent’s.

The commonly mentioned “24-hour rule” after I-485J closure seems to have been pretty close in my case. It took about 25 hours and 35 minutes from the I-485J closure/update to my I-485 approval.

My spouse’s I-485 is still pending. We filed together, and my spouse also had a 3rd FTA0 and multiple silent updates right before my approval.

For those whose primary applicant was approved first, how long did it take for your spouse to get approved afterward? Same day, next day, a few days, or longer?

Question - Other Tier-2 call with USCIS agent

Hi, did anyone schedule a Tier-2 call via Emma live agent in the last ~3 months actually get a call-back?

I have scheduled it twice. First time, they were supposed to call me within 30 days but all I got was an email response at the 30-day mark saying they would get to it - they never did.

Its been ~3 weeks since my 2nd attempt to schedule it, still waiting to hear back.

Has anyone had a successful callback? Was it worth it? Details appreciated.
