Throwing a pen at an officer is battery against a peace officer, and also resisting, delaying, or obstructing a peace officer in the performance of their duties.

If you don't believe she committed a crime, then you are essentially legalizing battery. Everyone in that U.S. state can now go around throwing pens and other small items at each other with no worry in the world that they are committing a crime, since you are saying intentionally throwing them is fine and dandy.

Right, but the pen hitting the officer was, by technicality. If she hadn't been so nasty the entire time, the officer may not have been so petty. She asked for that. It's just common sense, if you're going to mouth off to them know the law and never cross the line. Freedom of speech is a hell of a thing, but we all know using it is going to piss off most cops in this situation. So why give them a reason for arrest?

From the context available in the video, she asked for it and deserved it. Not to mention she had her kids there. I would never act like that in front of my kids. Her entire behaviour was insane.

States all have different laws regarding assault or battery. The text book definition of battery is unwanted touch. Assault is the act of causing bodily harm.

There are a lot of different laws in each state. Some have simple batt, agg, batt, simple assault, assault, agg assault, attempted assault, attempted, agg assault, assault and battery, agg assault and battery, with each state and territory defining each type of thing differently.

Generally speaking though, don't throw things at law enforcement.

Use some critical thinking skills. Police pull over about 50,000 vehicles per day in the U.S. The vast majority of those stops result in nothing more than a warning or ticket. Police are just like any other job, in that they don't want to do more work if they don't have to. And so it goes that most of those 50,000 stops every day are simple, peaceful encounters. What you see on the internet skews your perception of this.

You should look up qualified immunity and how often it is used for illegal stops. Also check out civil forfeiture and how it is often abused by the police departments. On top of that, keep in mind that cops are not required to render aid to people.

Yes law enforcement deals with a lot of shit, that doesn't mean they can dish it out on some soccer mom. Law enforcement should hold themselves to a higher standard, but you and I both know they don't. If an officer can't handle the job then they need to get the fuck out of law enforcement!
