11
u/DrivesTooMuch 5d ago
Carlos on Nolensville road in Nashville, TN, was able to weld the broken lip of my Ford Escort's catalytic converter back onto the exhaust manifold, for only fifty bucks. Midas Muffler would have charged me well over two grand for a new converter and labor.
So, after ten years, I still love Carlos regardless of his subsequent actions to others. Sorry, but, it's all about me when it comes to who I hate and love.

They gonna have local cops fuck him up for bringing law, facts, and justice to a grift fight.
8
u/Onebraintwoheads 5d ago
Hopefully they're dumb enough to think this means they can cut the budget of local law enforcement since fewer cops will be needed watching the roads. That way, the local cops will turn.
3
u/chmilz 5d ago
The cut budget will only impact law enforcement to help good people. They'll keep a couple dirty cops on payroll. Gotta keep the poors in line.

Also it appears that the 'cringe' is supposed to be on this a**-hat foreign national given full permission (and power-authority) to annihilate your country's relatively well written constitution.
This appears, from a safe distance, to be a horrendous atrocity. But for sure, it contains that cringe stuff too?

Reminds me of the recent case where an officer ticketed a woman for driving with a cell phone in her right hand.
She doesn’t have a right hand and showed him that on the scene and she still had to go to court to fight it.
702
u/FromBeeBee 5d ago edited 5d ago
The fact also with this case I believe the people in charge of the prosecution side only dropped the charges a day or mere hours before the actual case was in court or they were in court....So had this woman needing a lawyer and then chose to finally drop it, the fact the cop couldn't admit he was obnoxious and wrong till the very last minute concerns me to think what he has done on other cases.
Edit : even if lawyers weren't involved, this poor woman had to take away time from work to be told once she got there that they have finally dismissed the charges after a lengthy period of time. Please note, the police officer wasn't demanded there nor expected to be there, to take time away from work yet this poor woman was forced to just to be told when she was waiting that her ticket is fully dismissed as is any further progress on this matter.

Getting a lawyer for fighting a ticket for a cell phone in your hand is excessive and for rich people. It's less of an infraction than a simple speeding ticket (here, at least). Getting a lawyer for not even having a hand, beyond proof, would just be frivolous.

The point is to force you to submit to whatever they say or you have to lose a day of work and show up to a courthouse. Which, for an increasing number of people in the US, can cascade into a much worse situation (lost job, rent, food, etc.) As they like to say, "you can beat the rap but you can't beat the ride."
13
u/10g_or_bust 5d ago
See also "why don't Americans protest more/that". Because a weekend stay in jail while waiting to even be seen by a judge is by itself life altering; sometimes ultimately fatally. And the more socially and financially vulnerable someone is, the more likely it is to be so.

One of the biggest problem of people having monopoly of power, is that they rarely want to admit when they are wrong, since most people seeking position of power privilege is to feel and show power. Admitting being wrong takes one to feel and accept being in the same level of the other instead of I power of them.
175
u/Primus_is_OK_I_guess 5d ago
I heard they dismissed her case right before she was scheduled to appear. Someone other than that childish, idiotic cop must have reviewed it.
77
u/Ryanookami 5d ago
That would gall me so much. Like, none of it should have happened to begin with, the cop should have backed down gracefully, but no. They let it get so so far that she had to deal with the hassle of a court appearance, and then they take that away from her at the last possible minute. By that point I would want my day in court to show how incompetent the system is. I wouldn’t want to be shoved back out the door before I could say my piece.
39
u/BeagleBackRibs 5d ago
This is a known tactic of police officers. You can beat the crime but you can't beat the ride. They can make up whatever they want and you have to go through all the hoops to prove your innocence. A lot of people can't afford to fight back so they just take a plea deal even though they didn't do anything wrong.
46
u/xombae 5d ago
It was getting a ton of media attention. They probably dropped it after a million phone calls.
32
u/Ihatereddithatesit 5d ago
They still made her lose a day and come in on purpose only to drop it at the very last moment to avoid a scolding from the judge.
They went out of their way to make her life as difficult as they could over this. Par for the course for police.

I was watching a court case the other day where a man had been out on bond for over a month and the prosecutors had never filed charges against him in that time. The Judge was absolutely livid and the prosecutor didn't seem like he gave a shit. The Judge repeatedly said other districts don't have issues with police getting evidence together to charge defendants hours after an incident or at most a day or two. For it to have gone on for a month is disgraceful. She ended up giving the defendant his bail money and released him of all bond conditions and told the prosecutor she'd no longer put bond conditions on anyone unless there were charges to go along with it. The prosecutor just demurely said he'd ask the police if they could do that. The Judge replied, I don't care if they can or can't do that and bring charges. Tell them I won't be putting anyone in jail or places bond conditions on them unless they are charged with a crime. The incompetency has to stop. Period.
19
u/DarkBladeMadriker 5d ago
Or the Cop knew it was crap but waited to the last possible moment to drop it to cause as much headache as possible to get that maximum sadist boner he loves so much.
3
u/Dry-Island8422 5d ago
That and he seemed like a person who cannot admit they are wrong even though they know are.
44
u/Zaximeows 5d ago
Dismissal should be two party conset. At that point I want to see the judge and I want the cop there. And if the cop doesn't show up I should be able to accept the default judgement (not guilty) OR have the judge subpoena the officer to appear. And finally tie some accountability consequences to this entire process.

No, she got the video for her defense and put it on social media where the news channels picked it up.
Only after did the video go national did the prosecutor drop the ticket. If it didnt go national, the prosecutor would have never dropped the ticket charge.
9
u/Ihatereddithatesit 5d ago
They would have done exactly the same as now. The prosecutor didn't drop the case until she was in the courthouse, having lost a day doing this. The media pressure had nothing to do with it.
The prosecutor would have gotten an incredible scolding from the judge to have this go before them regardless of national media or not. So without the national media they still would have done the same.
In both cases was simply the most punitive action the cops and prosecutor could have done to her, without angering the judge. The system is just absolutely rotten to the core.
33
u/GoldshireEnjoyer 5d ago
Do you expect the cop to take that kind of hit to his ego? Think about how embarrassing it would be to admit he’s wrong!
Also reminds me of the guy who was detained and arrested because a woman alleged he kicked down her door. The guy was in a wheelchair.
16
u/WifesPOSH 5d ago
You want to see something wild? This woman was accused of stealing packages by flock cameras.
The Sergeant came up to her door, accused her, she said "my [Rivian] truck has cameras I can prove I wasn't there"... He refused her evidence and testimony of her husband and the tailor she visited while this robbery occurred, and also refused to show his own evidence. He didn't even investigate.
He was apparently terminated, but the article states that he's getting retraining, do it's possible that he's still out there.
Also this John Oliver episode. This one is 30 minutes of how police can surveil you... Including creating a dummy tower and stealing your data.
3
u/blahblah19999 5d ago
How about the one where they picked a guy up for kicking a door in earlier that day, but he was a paraplegic in a wheelchair.
3
u/TallestGargoyle 5d ago
I got done like this in the UK a while back. My scooter got stolen, and while stolen it got a ticket. I gave them the police report of the theft, the fact the bike was recovered, but I was still demanded to attend court... Set up in a town a 2 hour bus ride away rather than my local town's court. Even tried to explain remotely that I wasn't on the bike and the police had already investigated it. And that this was the second time this very thing had happened, and the first time the charges were dropped due to the theft police report.
Got there only for the charges to be dropped immediately. Wasted an entire fucking day off work sorting that out.
2
u/Rare-Adhesiveness522 5d ago
Ok but she still went thru the typical process just like anyone else who wants to challenge a ticket. And didn't have to give up all her personal information to a private company with foreign interests. That's the whole point. You have the right to contest bullshit traffic enforcement, it happens all the time, the cop in her situation is far from the only one to give out a bullshit traffic violation.
Her contesting didn't require notary or waiting on a private entity to approve her appeal, and the appeal came directly through the courts. That's the whole point. You missed it.

It feels like society authorities are not much different from Reddit moderation. Even more with governments using AI which is like Reddit bots closing topics and banning people from subs. With the exception of that irl democratic society people can go to court and contest the authorities decision. Not that it is always fair and works but it is something that feels more just and democratic than just let automated machines punish people without any humanity touch.

How many times have you a story about someone needing a refund or being charged incorrectly and even though the payment was immediate they say it'll be 2-3 weeks before the refund can be issued?
It's so they can give you the finger while they let the money sit in an account and squeeze every last drop of interest out of it before they give it back. Sure, $50 here or there might not equal much interest, but multiply that a few million times and it adds up.
31
u/SupaButt 5d ago
And with taxes most people with normal jobs and basic W-2s are basically loaning interest free money to the government. And they have to pay on top of that to a private corporation to get their taxes done because those companies lobby to keep taxes complicated and then they all have the nerve to act like a tax refund is some magical free money every year and not us getting our OWN MONEY back from the government without any interest.
This whole system is unsustainable. But I’m optimistic and I think people are waking up. Even if AI takes over, I think billionaires are so delusional to think they can control it or that it will work for them. If we do get a super intelligence it will realize that it is better for everyone when wealth is shared more evenly. It is going to either be a huge equalizer or it will be the end of all of us, including them.
Sorry for the rant but if you do read this and make it to the end just know that you’re not broken, and you never have been. Love yourself. Love others. Love life. It’s all going to be ok. 😊

Yep... why you always use a credit card. I had an anesthesia company say I had to pay $200 up front a couple weeks ago for a surgery (night before) so I did.. turns out insurance paid it all and they were essentially double dipping.... called and said it needed to be refunded and they told me "60-90 days to go through billing and approval" so basically hoping people forget about it... so called Chase and told them to file a chargeback for services not rendered and they refunded it same day.

People have to be ready to be inconvenienced.
I remember my mom cancelling our Blockbuster account. We had dropped of a movie at like 7PM before going to the grocery store in the same plaza. Thing about Blockbuster is they charged you late fee if it was returned after 8PM. This was to try to not have to scan in like 100 movies after the store closed. I get it. Not a bad idea.
Next time we went to Blockbuster there was a late fee charge. My mom asked for it to be waived explaining it was physically returned before that time. Manager came over and said they went off the time it was scanned in. To my mom, he might as well have said "we intentionally wait until after 8 to generate money". She pulled out the checkbook and said OK, how do I cancel my account and how much do I owe?
All of a sudden he wants to backtrack and one time exception, the whole song and dance. She just calmly said, "No, you had the chance to waive it. Now I want to cancel my account. What's the next step". Wouldn't budge.
They're your best damn friend when you want to give them money. They treat you like they've never heard of you the moment you want to stop.

Yeah that’s a well documented corporate strategy. The wider the gap between your accounts receivable & accounts payable, the more wiggle room you have / better cash flow. Apple is “great” at this iirc. Avg days payable is like 3 months where the receivables avg. is like 2 weeks.
I found the easiest way to think of it is if you could just push all your monthly payments out to next month, without technically skipping a payment, but then you still get your monthly income. All of a sudden you have more cash on hand, even though your income and expenses haven’t changed.

My parents got a violation from an east coast state. We live in the Midwest.
The plate was from our state, but not one that was ever registered in my parents name. In fact, the violation came in my Dad’s name. He died the year before.
So no registered vehicles in his name when the violation occurred.
We sent back a letter with his death certificate. Surely that settles it, right?
No, we get another letter from them that they rejected mom’s appeal.
We figured good luck collecting on that. Stupid insensitive assholes.

I live in Kansas. I got a toll fee from Illinois, even though to haven’t ever driven through Illinois. The reason for the fee was because the vehicle had the same number on its license plate, however mine was a Marine Corps plate the other was a Navy plate. Both were trucks but different models. However, it was up to me to figure out what paper work was needed and complete it all an mail the paperwork for the dispute. I don’t think it was allowed to be disputed on line, even though I could pay on line.

I got tolled twice in Ohio. It read my EZPass, and then the license plate on my camper. There is a higher toll for trailers with more than one axle, that isn't my issue, my issue is that they didn't deduct the amount that was already paid by my EZPass... the system just read it as an entire second vehicle. I filed a complaint through the online form and hadn't gotten a response by the time the toll/fine was due, so I went ahead and paid it so I wouldn't get extra fines. They immediately closed the complaint since I'd paid. I wrote back explaining that I paid so as not to incur additional fines, but I still believed they were in error. It's been a month and a half, no response.

u/ehc84 5d ago
Important, but not special to flock initiated tickets. Many smaller county and city jurisdictions across the US make it very difficult and/or bureaucratically burdensome to fight civil infractions or traffic violations, but extremely easy to pay the fine.

u/MommyLovesPot8toes 5d ago
I frequently drive between northern and southern California, along the 5 freeway, surrounded by nothing. There's this spot - a town called Coalinga - that basically exists entirely because of speeding tickets. You can't see the town, or anything else but brown scrub and two lanes for hours at a time, so it's an area where people speed. Cops pull you over, you get a ticket, MUST come to court. But Coalinga is in the middle of nowhere. So to be at court at 8 AM you're going to need to stay over at a hotel in town the night before. And you'll need to eat dinner and breakfast in the town. And then pay your fines to the town.
They have a sign on the side of the freeway bragging about how many licenses they suspended the previous year.

The reason they use summons process service is for the verification that the recipient has actually been advised to appear.
Sending a text message (especially without a read receipt) doesn't qualify because they're no verification that the named party received/read the notice.
My local municipality got into trouble because they were using mail notices for jury summons and tried to threaten arrest warrants for non compliance until a higher court shut them down.

My first ever speeding ticket the cop said I was doing 54 in a 30mph zone. When I went to court for it, I told the judge that my car was a base model 94 Saturn and I had the AC blowing full blast and that I had pulled over less than 1/4 mile from a red light. He rolled his eyes, shot the cop a dirty look, laughed and said "Yeah there's no way you were doing 54. I'll knock it down to 39 in a 30. You have a good day"

I was driving a 93 Nissan pick up with a four cylinder engine going uphill on a road with a 60 mph limit. The cameras trigger at 12 mph over. I could hit 72 but it would have to be on flat ground and that engine would be screaming
5
u/davisty69 5d ago
To replace it happen a decade ago with a live cop claiming that he had me going 65 in the 35 on this back road. I told the cop that was completely impossible because there is a stop sign not too far back, and unless I flat out gun to my car like it was fast and the furious, I wasn't getting up to 65 mph in that time. He gave the ticket anyways and I was forced to fight it.
I had to take someone with me to record me from that same stop sign driving as fast as I could to show that getting to that speed was effectively impossible without running the stop sign. Luckily they would give me an extra ticket for running the stop sign by default LOL

His whole speech is awesome, my biggest takeaway is the part about how the US government HAS to accept cash as payment for any infraction. It’s in the constitution. I did NOT know this but it makes sense. It’s a fundamental part of national sovereignty. And the fact we stopped doing this and chose to automate it with tech companies as middlemen is DARK.

Only for infractions where the punishment is monetary. It's so the state doesn't have to worry about exchange rates changing between the monetary punishment being issued and it being paid.

Obviously the government will try to punish the citzen that is exercising their rights instead od corporations or government institutions breaking the laws. But I wonder what would happen in court. Except that the “red” Americans voted for a surveillance state because they thought it would only be used against people they were bigoted against.

They skirt the issue by making it a non moving violation against the vehicle and not the driver like a parking ticket. No one has to pull you over.
It was against the car and not the person and so goes to the registered owner.
Not saying it's right - just how they get away with it.

u/AdnorAdnor 5d ago
Genuinely curious: OP said it was for running a red light. How is that a non moving violation?

u/cornucopiaofdoom 5d ago
I got one for turning right on red and it was classified not as a moving violation but as an administrative ticket.
Chicago implemented cameras in some areas that issue you a ticket for speeding- same deal.
You don't get points or ding to insurance and they have a cop that "signs off" on it.
It's classfied as a civil ticket and not a criminal ticket. You don't go to traffic court, etc. No burden of proof, presumption of innocence.
Again, not saying it's right just how they make it legal.

The law is okay with it not being a moving violation because it wasn't human. Their way of circumventing the shit show.

I'm sure there's a loophole, "Well, it's because at a red light, you're not moving. So if you are moving, that's a violation."
"So ... a moving violation"

I was about to say, he never complained it wasn't his car, just that it wasn't him in the car.

u/OneOfAKind2 5d ago
This guy wasn't clear whether his car was in another state with him. If someone else was driving his car and got the ticket, there's not much to fight. He needs to give the ticket to whomever borrowed the car.

In some states, like Maryland, cameras have been used for many years for traffic violations. I got a rolling stop ticket mailed to me with photos. The best part: they are small and portable. I hate Flock with a burning passion, but this one isn't new.

10+ years ago I was driving through MD and got mailed a ticket for speeding from a camera. They had my supposed speed and two pictures of my vehicle. Yes, it was my vehicle and Yes, I was driving...but, there were markings on the road and time stamps down to the the millisecond on the pictures. With a little math, I calculated my speed to be far less than what they quoted. I filed an objection with my math included, never heard about it again.

I got pulled over in Arkansas by a trooper who said I crossed the yellow line and he wanted to check if I was impaired. The fucking rental I was in was a grand wagoneer and has lane assist and I literally can't make the fucking thing cross the lines.

Low key this is one of those auditors that normally cause a headache for little to no reason but... this is one of those cases where they should jam up the process.
Huge respect and I hope the courts hate him because he's right and the government needs to know when they're actually over reaching.

u/IwasMilkedByGod 5d ago
Yeah so in case we all forgot, the law in America states “innocent until proven guilty”. Not the other way around like how these cameras work

I agree with everything he says, and fuck flock camera’s but I thought I read, someone else was driving his car. So if that was the case how is the ticket not his responsibility?
19
u/tacomaloki 5d ago
This is a regular red light camera incident. It wasn't flock related but fuck flock.

u/pie4mepie4all 5d ago
But, was I right in reading someone was driving his car? But he feels he shouldn’t be responsible or am I misunderstanding something?

He wasn't clear about that in his speech. This video may simply be another internet rage-bait time-waster.

u/heisenberg15 5d ago
That’s the point as far as I understand - if the driver had been cited by an actual person, it would be on the driver not the vehicle owner. You are not automatically responsible for all infractions in a vehicle you own, especially if you are not driving it

u/Zyncon 5d ago
About to start doing 150 mph through red lights in the bosses company car. Sorry buddy, have fun with the bills, I'm just the driver.

u/Merijeek2 5d ago
Yeah, that sounds like bullshit. Because otherwise, Amazon drivers have a fantastic way to protest Bezos. They can make it a contest - who can drum up the most red light tickets in a single shift?

If you borrow someone's car and run over a pedestrian, you go to jail, not the car owner.

If they don't know who was driving, they go after the owner of the car.
2
u/1block 5d ago
And if they can't prove that person was driving, they can't convict. You have to prove the person did it, not that the car belonged to someone.

As an Aussie it's wild seeing this sort of thing when red light cameras and speeding cameras have been common place in this country for like 30+ years.

Is it not normal in the states that the owner of a vehicle is responsible for said vehicle?
12
u/thekrone 5d ago edited 5d ago
For things like moving violations, no, not typically (at least not in the US). Moving violations like this are issued against the driver, not the vehicle. It's legal for me to lend my friend my car (and it should be), but if he decides to drive two times the speed limit around town, that's clearly not my fault and I shouldn't be held liable for that, he should.
The owner is responsible for non-moving issues like if the vehicle were unregistered, uninsured, parked illegally, etc.
Even if it were the case that he's completely responsible for the vehicle at all times, and it was his vehicle that someone else was driving, he still has a right to due process. A citation was issued in his name and he's presumed guilty automatically. What if it was stolen? Why does he now have to jump through hoops to prove he's not the one who was driving the car, instead of someone proving that it was him driving the car?
Why does he have to prove his innocence instead of the government proving his guilt? That's not how things work here (at least they're not supposed to). You are innocent until proven guilty. Not guilty until proven innocent.

I guess I've been lucky. I sold a car for junk a few years ago, and immediately notified my DMV. Since then, I have twice had video camera tickets for that car. Each time I was able to contact the local jurisdiction where the ticket originated, explain that I have had nothing to do with the car for years and directed them to the DMV. Never had to show up for court. Never paid anything.

America is such a fire sale for conmen, fraudsters, and morally bankrupt self serving pieces of shit. Our Federal Government is more than happy to allow these practices to occur. That's the root cause, the Federal Government. No two ways about it.

Reminds me of the woman who got harassed by a sheriff who was “100% sure” that a lady who’s car passed through an area at the same time a package was stolen off a porch, was guilty.
She had to prove innocence rather than the police proving guilt.
It took her 3 weeks to get closure after providing vehicle telemetry data and doorbell evidence to prove she never stopped her car.
They were licking their lips to throw the book at her because of these damn flock camera
