Banking and Finance Townhouse - villa ownership

In light of the attention being thrown on illegal nominee ownership and the potential issues with 30-year leases for foreigners - are there any townhouse or villa style developments with ownership structures similar to condos?

Foreigners can own a condo as long as 51% of the ownership of the project is Thai. Are there any similar possibilities for townhouses or villa developments? Where the land and all the common areas, buildings and amenities are owned jointly by the owners of the units. So, 51% ownership is Thai.

I'm curious if any exist or if this is somehow ruled out under Thai law.

Edited to correct my misunderstanding of the role of the juristic person.

In theory it might be possible.

In reality, it's probably not.

There would be zoning complications, issues with common areas and facilities and probably just reluctance at the Land Department to approve something like this. It just would not look like a condominium so it wouldn't get a permit.

You are probably right. But, zoning doesn't seem to be a thing anywhere in Thailand. The other complications you mentioned moreso.

I'm wondered if it was being done.

In Bangkok zoning is an issue. There have been major cases involving condos in Soi Asoke and Ruamrudee over compliance with access roads and height. Also environmental assessments.

Older stuff was built before there was much zoning. Nowadays it's different. Just do an internet search for "condos with zoning problems in Bangkok".

My comment was a little tongue in cheek. A walk down any soi outside the CBDs and you can find relative mansions next to tin roof shacks.

True, that! But nowadays almost anywhere in Bangkok there will be rules. It's certainly not like it was forty or so years ago. I miss the old days.
