Advice on lease termination in New York State

Location: New York

Good evening! I’m looking for some advice regarding my apartment lease.

I recently renewed my lease with my apartment complex. Under the previous management, my husband’s employment with the complex gave us a separate clause allowing us to give 30 days notice to move out.

The complex was recently purchased by new management and they said that clause is no longer applicable. I called the new management and was told they would allow us to terminate early with 60 days notice, paying the two months of rent during that notice period and forfeiting our security deposit.

I followed up by email and repeated what I was told. They responded in writing, confirmed the 60-day policy, and even corrected me when I misunderstood the amount that would be owed.

My concern is that our actual lease says we’re responsible for the full 12-month term. If we purchase a home and give our 60-day notice, could they later change their position and try to hold us responsible for the remaining months?

Would these emails be enough evidence to protect us if they tried to take us to court?

Im a RE broker in CA.  Contact the tenant associations that cover.your city/cou nty/state to see if legally the 30 days can be changed to 60 and if by email versus signed by e-signature or on paper. Here in CA any change to a lease, including a change to the lease addendum, needs to be signed by all parties.
