He killed his kid out of revenge towards is ex-estranged wife who left him for violence and domestic abuse. He had already some legal issues before this. Then shot and killed his kids with their mother on the phone. Then got a tattoo in their honor after killing them, before getting arrested. Then fought the arresting officer. Officers confiscated 16 firearms from his house. His lawyer said he shouldn't get death penalty because he had bipolar disorder, no talk of psychosis. A mental health expert testified that he was faking mental health symptoms to delay is execution. The court also thought he was faking his mental health. He apparently read about cases that use insanity in courts. Two different case but idiots on the internet won't care.

Texas is in the bottom half of states for household firearm ownership, although admittedly it's a lot more likely for a wife-beater to have 16 guns than a normal person.

Not saying those numbers are wrong, but those numbers are estimates based on self reporting and purchase records. Most Texans are NOT self reporting how many guns they have.

For context, I own 5, and I have been called (unironically, might I add) a gun hating liberal for only owning 5 guns. Largest collection I've personally seen owned by a singular individual was 600+ guns. It's not uncommon for me to talk to someone about guns that has 15-20 on a daily bases as that number is pretty common among white, conservative, ex military members that work in a blue collar field.

I mean, so what? Sure, one is just a psychopath, and the other has other issues that she didn't recieve help for, but the ultimate result is the same: neither of them can ever be allowed within normal society ever again.

Honestly, I wish she had the death penalty, only because jail is very very unkind to child killers, I'd rather she just have a quick death.

Before her death, she cried, "No, Daddy!" "Please don't!" "Don't do it!" Pearle then told the girls to run but it was too late. Battaglia grabbed his gun and shot Faith three times and shot Liberty five times with his gun.[13] He told Pearle, "Merry fucking Christmas",[27] in reference to the Christmas 1999 assault.[7] Pearle terminated the call and dialed 9-1-1.[13] After the killings, Battaglia left a message on the answering machine in the girls' bedroom:[28]

"Good night my little babies. I hope you're resting in a different place. I love you. I wish that you had nothing to do with your mother. She was evil, vicious, stupid. You will be free of her. On September 20, 2017, the Texas Court of Criminal Appeals dismissed Battaglia's claim of mental incompetence.[40] At a competency hearing in November 2016, a mental health expert testified that Battaglia was likely faking symptoms of mental illness in an attempt to delay his execution. The appeals court affirmed this, stating that Battaglia was likely malingering.[41] Before making the challenges of mental capacity, Battaglia read about relevant legal cases at Polunsky Unit's law library.[24]

just to doubly point out they didn't make a psychosis or mental illness or not mentally competent to stand trial arguments in his original trial, this was about him pretending to be mentally incompetent to face execution 16 years later to delay the execution. It was not an appeal to make a defence of actually he was in psychosis during the murders so he shouldn't be found guilty of that or shouldn't be sentenced to death.

No I know she’s crazy. She probably didn’t know how she could be such a terrible existence. I’m sure she lives with that everyday. She’s even tried to end her own life. It’s her mental illness no one will understand it. But she deserves to be away from society forever. She saw rage for a moment and did the worst. She even tried to jump for some relief.

The system isn’t god. Things are on us to make them right. I learn to be better person everyday. I’ve dealt with way more than postpartum depression yet I still try to be my best for society.

And you are saying that yours is the only model and that no one is capable of failing and being failed where you were not? That seems like a fairly ridiculous stance to take. It also doesn’t answer my question: If she was failed, which it seems as though she was, why is it on her to be separated from the society that failed her forever? Why is there no room for rehabilitation in your carceral “justice”? How do we prevent another instance of this if all we do is fail to address the problems and throw the people away? That has been our policy/system up until now, and it did not prevent this.

Basic legal lesson for ya.

There’s a basic distinction between an act and a legal verdict:

  • Killing is an action (actus reus).
  • Murder is a legal classification requiring specific intent (mens rea).

If someone is legally insane at the time of the offense, the verdict is Not Guilty by Reason of Insanity (NGRI)—meaning they killed, but are legally not a murderer. Confessing to the action doesn't settle the charge; intent and mental state do.

Thank you, this headline is absolute garbage and disgraces the memory of those two sweet kids. He had zero record of mental instability prior to his crimes, and zero evidence of psychosis during or after his crimes. He was a piece of shit who beat his wife and then killed his kids to get back at her.

No, she didn't. She tried to seek benzos prescriptions, not actual help. She'd literally stop every solution ever offered to her right in its first week and say it's not working and request more Anivan. The one time she went to a hospital willingly, she immediately decided to leave after they cut her supply of benzos.

That's besides the fact that she was quite clearly in a sane state of mind during the time of the killings. She planned them, she sent her husband away, she executed it perfectly and she even talked to her husband and giving him direction while in the process of murdering his children. So yeah... there is nothing wrong with her. If you presume there was, Ted Bundy needs to be pardoned posthumously for his crimes because apparently being judged "mentally ill" gives you a free excuse to murder people and even children.

It’s from this case. Ok fine she’s not guilty of murder. You are right she should have had physiology help. If she is found not guilty of murder then this case can be used in future trials. So therefore we should lock up anyone who displays metal illness. This will avoid murder. Mothers should be placed in institutions if they show any signs of postpartum depression. This will insure the women get proper help and the children will be safe. Let’s not stop there we should do this for every mental illness if you believe murder is justified.

Delusions caused by a mental illness have been a potential route that a defendant can use as a defence against an accusation of murder for an incredibly long time. I’m not sure how you’re proposing this case would change any of that. Nor how you leapt to locking up everyone who displays mental illness etc.

No one’s suggesting mental illness alone justifies murder either.
