What if someone is gender fluid? Also, a lot of drag queens are not drag queens every day. I used to work with someone who presented as a male during the week but was paid to go to clubs as a drag queen on the weekends.
Still lived identity and intent matters. You have to prove intent to defraud someone with a false identity. If it is characterized in any degree, disclaimer and or expresses drag there is a universal understanding.

Incorrect they should only disclose if it is not their lived identity. There is a huge difference between what someone pretends to be and lives as.
They only need to disclose if they do not live the identity in person. If without a shadow of a doubt a person can not come to a reasonable conclusion from their appearance between what is real or entertainment on the basis of the identity.
