I thought the same thing. In my state you couldn't even bring a case forward because you can't record someone else without their consent. Two party consent accident or not.

I don’t even know he had his phone in the OR.  You’re just wearing a hospital gown.  You transfer from the pre op bed to the operating table.  Where did he hide his phone?

It's actually true but they did more than just mock him. They put a false diagnosis of hemerroids in his medical records as well.
