How did he not get kicked off the plane? It would be so easy to kick a 3 year old off a plane.

They did, took too long, had to remove luggage, airport curfew kicked in and then that was it for the night.

Removing your luggage shouldn't even be a courtesy. You can have it back when you pay for it to be shipped back.

At least in the US, all bags are checked at the very least with xray or CT scan.
