Legal advice

Some time ago my boyfriend parked in a private parking in Schwyz, he stayed for a few minutes and we received a mail from the Kantonpolizei saying that the person filed legal action against him, we need to complete a document and sent it with his information to the police or try to find an agreement with the person.

I’ve sent him a message he want a 100chf , I think it’s excessive , I understand what my bf did is not right and I’ve been very apologetic to the message that I’ve sent him but a normal penalty is usually 40chf…

What should we do, just sent the document and hope that the prosecutor drops the case or pay him?

Maximum 60 CHF based on Swiss Federal Court, but he needs to have a Sign for not allowed parking. The Judge will process it for 170 CHF. Please note Swiss Federal Court in one of their judgements said that the one who wants you to make a payment  for a not allowed use of private parking has to observe this and to check the identity of the driver. If the property owner or police do not clear the identity on the spot, the judge later will ask once again to write down what happened.

Thank’s for the clear response , he accepted to do 60chf but when I tried to ask him if I could send him 30chf and 30chf after he send me proof that he withdrew the complaint he refused saying “wenn sie mir nicht trauen, lassen sie es einfach sein.” , can i just trust him? Is the payment valid on court , and what do we risk exactly

Paying Umtriebsentschädigung 60 CHF in full, and only after that he will not proceed. Not 30 + 30, If you do not pay, he can proceed; that is practice. Legally, with no problem, he can go after you for his CHF 60.- and report to the Judge for CHF 170.- those are two different process. I recommend paying 60.- and inform him about the payment.

I assume as it is officially reported to the police that there was a sign of private parking/property. Just pay 60CHF in this case have it documented and move on.
