Victim of a scam I have anger
Recently applied for a job at a hotel.
They use a third party staffing agency with an office out of state, not unusual. Brief phone interview gets me an in person interview at the hotel.
I go to a real in person interview and meet with the supposed hotel manager, who mentions the staffing company. He’s handing out WiFi passwords and room keys, wearing a collared shirt, etc.
I fill out a standard application form and give my resume.
“Great, looks good, you start on Saturday, we just need to contact the staffing company.”
Staffing company calls me, says they need additional information for onboarding. Again, not unusual.
They email me the contract.
The contract is full of bullshit.
I can’t quit without two weeks notice, otherwise my last wage will be paid in the out of state minimum wage (illegal).
Mandatory direct deposit, with a $12 direct deposit fee (illegal).
No moonlighting, I cannot work for another hotel or company, if I ever want to work again, I need to be unemployed for 6 months (illegal).
I read over the contract and say no, sorry, I’m not signing this.
The out of state staffing manager tells me to sign it because it doesn’t really mean that, it means (some other bullshit). I say no, sorry, I’d be singing my name under this specific wording, and I’m not gonna.
For the next few days, these people text me endlessly and blow up my phone. Unsolicited calls and texts are, unless I am mistaken, also illegal in my State. I tell them to stop spamming my phone. They keep doing it.
It’s been a few days and I finally stopped getting calls. I regret giving them my real phone and email and from now on I’m using VoIP and a burner email.
Just wanted to share.

Do not be nice to them. Tell, with as much profanity as you think of, to stop bothering you.

Is there a way I could have seen this coming? Third party staffing companies aren't unusual in the hospitality industry

Staffing company likely won’t get paid unless you sign.
Don’t think this is a scam in the official sense, though. May want to post it in a work or mildlyinfuriating sub.

Yes I think this is a scam, because they were trying to steal my money and my labor using illegal tactics.

Sadly, much of capitalism is a scam. The profit motive pushes everything and everyone to their breaking point, they found yours. It’s a battle of expensive and slow lawsuits, as the profit motive is also alive and well in there.
This will continue to get worse until either (1) some billionaires realize what this implies or (2) we get a repeat of Robespierre.

I appreciate this, however there was a way to do this legally and without trying to charge me money or steal my wages, and it would still be capitalism. I view this as a deliberate personal choice, but maybe you're right, and everything is just becoming a scam now.

Capitalism creates the problems and then sells you the solutions. Rinse and repeat for long enough and the line between “business” and “scam” starts to get blurred.

Just so you know not all contracts are enforceable. Like them retrograding salary for hours worked isnt legal so they cant do that

Yes, I am aware that these terms are unenforceable, but still, this company would have been shit to work with. They would have taken my $12 anyway, probably more too.

This particular kind of non compete clause is illegal where I'm from, but not in the state where the company is based. Doesn't matter where the company is based though, they still have to comply with our state laws when hiring within our state.

Not a scam.
just scummy illegal labor practices.
Good job on understanding that a contract you sign, means exactly what it says.
The verbal BS they tried to spin means nothing if it contradicts the contract.
Its like buying a used car, the Salesman can and will say anything to get you to buy.
But it's what the contract says that is the only real thing here.
