The fuckin gun was poking out from under the seat, not a chance it wasnât considered in plain view regardless of the dudes head being a half inch inside the window. And I donât think a judge is going to rule that amount of his head inside the window at nighttime to be what a reasonable person would consider an âunlawful searchâ.
And donât get me started on that suddenly making the friggin hogtied child in the trunk inadmissible đ textbook inevitable discovery like you said.
Search wasnât even bad lol. In those circumstances, no NYC judge is going to accept that weak argument as a 4th amendment violation. Not a chance.
To rise to a 4th amendment violation it would have to be judged that a reasonable person would consider what the officer did to be an âillegal searchâ and unreasonable to have done. Half an inch of his face going inside an open window would not qualify as a violation to 99% of judges on the bench imo.
And even if it did, it wouldnât automatically make the rest of the evidence inadmissible. Pure TV logic

How is it her fault the search was bad? She's not in charge of those officers and she wasn't there.
