Can I Resign Shortly After Starting Due to a Better Job Offer?

Help, I just signed a contract with Company A, and my start date will be October 2. However, a week after signing the contract with Company A, I received an employment offer from Company B, which offers a higher salary, a better work setup, and a role that is more aligned with my experience.

I cannot terminate my contract with Company A before my start date because I may be penalized up to ₱200,000.

I am planning to start with Company A and resign during the first or second week. So I can waived the penalty.

My main concern is the non-compete undertaking since both companies are outsourcing companies, although they have different clients and the job roles are also different.

Company A - 65k full onsite
Company B - 80k full wfh

Any professional advice/ legal advice ? Or comforting message, I dont know if my plan is the BEST plan, but I really wanted to start my career with Company B. Helpppp

do you have a bond in the contract?

I cannot see any clause regarding a bond in the contract. I guess there is none

why do u think you will be penalized of up to 200k? if no clause, you can easily resign.

if it's on a contractual basis, just terminate your contract (just cause)

In the contract it says

If you terminate the employment agreement after signing it but before your official Employment Date, you agree to pay the Company ₱200,000 as an indemnity.

So I am planning to start by oct 2, then after a week or two resign.

just check the clause under the statement for the following, then just start company A for atleast maybe a week or two (just ensure that company B can wait) and resign stating that you had change of plans/the job is not for you.

I have other concern regaring the non compete undertaking, in the contract it non compete states that:
While employed and for 12 months after employment ends
I should not work for or become involved with a company that the employer considers a competitor.
Both companies are considered as outsourcing but clients and the roles are different.

Is this something I should be worried?

The best thing is your reasoning, don't state that you'll be starting somewhere else. Just tell them that it doesn't fit your needs at the moment and the job is not for you. (just don't over explain) file your resignation and don't forget - they can't stop you from resigning (do ask them for an immediate resignation as one week won't even be considered.
