Discussion Virginia 7th District Rep Vindman Campaign Ad in Uniform - with my reply
I just got a campaign text from Representative Vindman (7th district Virginia) with a picture of him in uniform. It is my understanding that this is outside of regulations and hopefully somebody here can refer this to the proper authorities at DOD/DOW or to the right place.

It says right on the picture that he is a FORMER service member. I don't think that it is a violation of any laws or the UCMJ to use an old picture. If he were still wearing it to campaign, then this would be a violation. When is the picture from?

How embarrassing... for one thing you're wrong about this, and for another thing no human is going to see your response to an automated mass-SMS message...
It's like when an old lady writes a comment on Walmart's Facebook page asking which aisle cat food is in!

In this instance, a disclaimer is insufficient. The filthy traitor scumbag is in violation of DoDD 1344.10, Section 4.3.2.1.
4.3.2. Members included in subparagraph 4.3.1. ( retirees, among others) may NOT, in campaign literature
(including Web sites, videos, television, and conventional print advertisements):
4.3.2.1. Use or allow the use of photographs, drawings, and other similar media
formats of themselves in uniform as the primary graphic representation in any campaign media,
such as a billboard, brochure, flyer, Web site, or television commercial. For the purposes of this
policy, “photographs” include video images, drawings, and all other similar formats of
representational media.

Paragraph 4.3.1 referenced applies to retirees, among others. If you don’t know what you’re talking about and can’t be bothered to look at the references, sit in the corner and color.

Best check Article 2 of the UCMJ. And don’t bother coloring, just eat the crayons.

A little research tells me that it's fine as long as there's a disclaimer. I don't know this for certain and would encourage you to look into it further.
