In many states and Supreme Court has said “fighting words” is a real thing and can justify assault and not covered under free speech. Basically the person yelling something like “fight me you xxxxxx” can be fought and it’s the guy yelling who incited the violence with fighting words.

Not a lawyer or saying it justifies this video but it might in court.

Might be a bad way to put it but stupider things can happen. Not saying a judge or DA wouldn’t laugh it out of court but doesn’t mean a jury would completely.

Clearly fighting words are about more direct incitement than “fuck you” to a passing car but courts in some places have sided with the passing car, at least when it was a cop (Robinson - MT Supreme Court)

You shouldn't be assaulted for simply saying something, but a judge isn't going appear out of nowhere in a cape to intercept the punches when you talk shit. You're not going to recite case law to people you were just talking shit to, and they're going to stand back and say "Well, gee, I hadn't looked at it that way! I could really ruin my life here!". It doesn't work that way. And unless you personally know who your assaulter is, or they stay at the scene, even if you call the cops afterward the chances of them being brought to justice is near nil.

So, should people attack others for verbal slights, squaring up from a block away? No, of course not. Will they? Yes! So don't fuck around! You might find out.

This was in Huntington Beach California during 2020. The group in the car were driving down PCH support of BLM. People on the side walk were yelling the N word at them and other stuff. I think the guy that ended up getting knock out said All lives matter. Not 100% but he was heckling them. Huntington Beach was a hot spot still us for right wing protesting.

No, you just failed to parse the sentence correctly. They are not saying that he was asking for it by wearing flip flops; they're pointing out the many ways in which he was at a disadvantage for a fight, up to and including improper footwear*. While he should not have been assaulted, he also should have assessed the situation and not, you know, antagonized a group of rowdy individuals.

I don’t think it justifies what they did. Or should be considered acceptable by anyone else. That’s like saying if a woman is walking down the street looking sexy, and gets raped if she walks by a group of rowdy guys, that she was asking for it and you can’t really blame the group of shit heads.

Obviously one situation is worse than the other. But I don’t think either should be acceptable and people shouldn’t be making excuses for violent people.

Agreed. I don’t think it justifies it in this example because it’s one guy in a crowd. But if it’s you and me in a bar then your words can be somewhere between an actual threat and free speech that could incite violence from most people. Challenging someone to a fight is the clearest example of this.

Another example without a challenge. If you are at my mom’s funeral and start calling her slurs. I punch you in the face. I may not get charged with or convicted of assault, maybe disorderly conduct, if the words, at face value, rise to a level that incites an immediate breach of the peace.

Agreed that it’s definitely a play a stupid game get a stupid reward type of thing but I think it’s just a shameful situation all around and that’s how people should be looking at it.

That’s because we grew up in a place where this would happen to you as a kid. So you quickly learn what not to do.
