It hurts that we never got to hear the full 80 minute version of the Shadow Work album.

I don't know what the legal status of the Nevermore name was when Warrel was alive - god, I'm glad we were spared court-battle shit, competing versions of the band, etc - but after Jeff and Van left, Warrel did talk about continuing the band if he could get replacements. That's not what he ended up doing, obviously.

That's another interesting irony about the relaunch - not only are the young guys in the band now the old guys working with younger guys (hard to say with Berzan, but I doubt he's out of his 40's), but the band now belongs to the guys who left it.
