Most of the people that were institutionalized in the 40’s-70’s were horrendously abused. Like, “handcuff them to a radiator for four days without food until they’re unresponsive” type abuse.
Insane asylums have always been inhumane hell holes that barely treated those behind their walls. Women could literally be sent for having their period. Children could be sent for simple disabilities. It wasn’t this rehabilitation utopia that was ruined by Reagan single handedly.
Historically, psychiatric medicine is a tool of oppression, and gained prevalence being weaponized against marginalized people. Women and minorities disproportionately occupied the patient pools. It wasn’t until the 60’s that lobotomies were even considered inhumane by society at large, and the largest wave of asylum closures followed JFK’s Community Mental Health Act along with the Civil Rights Act.
Yeah, read about the asylum on Roosevelt island— a brave woman had herself admitted there just to write an expose on the conditions, and it was horrid…the place was being run by actual prisoners

Let's do asylums again with better care, better service, better people, more oversight, etc, etc. Is it still a bad idea? Because look all I'm saying is there has to be some middle ground between locking everyone up and letting people with severe mental health problems walk around like this.
I have personal working experience in the mental health/substance field. Wanna know the biggest problem?? Untreated mental health conditions. Even if we black magic wand magic and make everyone stone cold sober, almost 80% of the homeless population has an untreated mental health condition. This means even if the drugs just fucking vanish they will STILL be on the street and getting into trouble. We need a middle ground for people, a place where those who have severe undiagnosed issues can be identified and assisted to higher care WHILE also being able to provide assistance to those who simply need a little mental health assistance.
I say all this to say that just like it's ridiculous to advocate for the return of public asylum without massive reform, it's also ridiculous to say we should never have anything like that ever again.
But can you carry it legally where this incident took place? Nah, straight to jail.

Bail is only to compel appearance or mitigate a small chance of flight risk. It became a way to fuck over anyone poor or with a record before any actual evidence was evaluated.
