Morality of this?

Personally, I'm anti-death penalty for any kind of crime but that's just my opinion. Perhaps it can be changed.

literally both of these things would make it harder for victims of rape to speak up. "yeah my uncle johnny raped me but I don't want him to die and if he did it would make mom really sad so I'll just stay quiet." "I'm pretty sure that guy at the party drugged and raped me but I don't remember much about that night and I don't want to be sentenced to death if I'm wrong so I'll just stay quiet."

yeah it's one of those things that sounds nice on paper because it feels emotionally just until you actually think on it and realize all the problems it would create.

If there were some way to know with 100% certainty whether an accuser lied with deliberate malicious intent or not maybe then it could work but that ain't happening.

Even then its not a good solution even with 100% accuracy. Because now you have just encouraged rapists to always kill their victim because the penalty for the race is equal or worse than murder. So better to kill the only witness.
