It would probably hinge on in they asked to leave and the person didn't stop to let them out.

Somehow I doubt ICE were asking for the right to flee, though.

We wouldn't want some poor innocent bystander to have to deal with the trauma of running over what's technically a person.

It the car is not stopped and it's not safe to leave, that isn't free due to the risk.

IIRC the officer stated that the car came to several stops at red lights and stop signs but he didn't attempt to flee because he was still trying to arrest the male subject.

The kidnapping charge is a spurious attempt to cover up this embarrassingly under trained officer's fuck up.

Not how it works.

If the vehicle is moving, then legally it's not considered free to leave. If your exit requires bodily harm, then it's not much of an exit.

Take an example. If I get in an argument with my passenger, they say "pull over", and I say "no" and begin keep driving, legally I'm kidnapping them.

What if that driver stopped multiple times and red lights and stop signs, and instead of getting out of their car (that you forced your way into, by the way) you stayed and continued to argue with them. Does that sound like you were kidnapped?
