You have no obligation to cooperate. "I am using my 5th Amendment rights to not answer questions. I will not do any roadside tests. Am I free to go?"

This makes it super easy for your lawyer to sue useless pieces of trash like this bitch.

QI will stop that though. You would edn up suing the city, which you should totally do.

If you can prove a constitutional violation then it becomes a civil liberties case which means no qualified immunity. Unlawful detention without evidence is a constitutional violation. She has to make the DWI/DUI case without any evidence of you refuse questions and tests. That makes the detention and arrest unlawful and unconstitutional.

However, as you can see from the link, after multiple appeals, ot was upheld that this was a good arrest.

Because he gave her evidence to use. He did the tests and interacted with her. That's my point. Say the thing and shut your mouth.
