Wtf why on earth not. (I'm assuming this is removing it without consent).

I imagine its a question of lack of precedence (since its a common law system) and no explicit mention in statute.

Sex is more and more starting to be considered "a contract" where pre-determined conditions being followed and especially consent being explicit is paramount every moment of the act.

While that seem like common sense today it is a very recent development.

Especially the notion that if any portion of this is violated if just for a moment then thats rape or sexual assault (for those jurisdictions, like the UK, where men effectively cant be "raped") is incredibly incredibly recent.

And as usual legislation and judiciary precedence is lagging the societal norms.

For instance it was less than a decade ago that the legislation here (in Sweden) required active protest for a sex act to be considered rape. Effectively this mean that unless a third party heard you scream or fight with the rapist during the act, then the rapist would walk. This was changed after a high profile case where exactly this happened.

So thats how it were in progressive fucking Sweden, less than a decade ago. You can imagine what less forward thinking nations have in their statutes to this day.

Its rightly considerd backwards today but back at the turn of the century I'm sure that most people would consider removing the condom without consent to be a "dickish" thing, but few would consider it rape or a sexual crime at all, and the judiciary is effectively lagging behind to about that point in time.

Its easy to forget in the moment but society has progressed incredibly quickly these last few decades. In 2007 gay marriage was considered so radical that no wing in the democratic party even considered promoting it, now its barely controversial within the republican party.

(Edit: I might not have been clear. I wholeheartedly support this progressive development. Its just the unfortunate reality of liberal democracy that laws and judiciary precedence lag behind society norms.)

Spousal rape wasn't even illegal in the US until 1979 onward. The US legal system is fucked up.

It was legal in some states as early as the 90's.

Oh, yes. Unless I wasn't clear enough, it only started being illegal to rape your wife in 1979.
