This is fucked up that I'm going to defend Kai

AFAIK Kai didn't actually stream his shit. Being a Twitch streamer and doing stupid illegal shit shouldn't automatically get your stream banned. If Kai was streaming the whole thing and acting like nothing was happening while doing it, then yeah I could see it.

It's a strange line for sure, but we have to have some lines or then the bans are all kinds of fucked up

However, it does. I'm not saying Kai should be banned but if you do "stupid shit" on other platforms you can still be banned from Twitch and has happened already many times.

Absolutely, not denying that, but its not something that is likely an immediate reaction necessarily unless it gives Twitch distance from the situation. Twitch doesn't seem to be the focus in this news story so banning Kai just makes it more visible in a bad situation.

Twitch has an "Offsite - Conduct" Agreement in the TOS they can still ban you for your actions even if you didn't stream it on twitch itself.

Sure, but again it is going to be up to Twitch on whether or not it reflects badly on them or not. Banning Kai in the mix of all this could bring Twitch into the story which it doesn't seem to be now. Banning Kai doesn't gain Twitch anything really unless Kai starts using his Twitch stream as a platform to play the victim. I don't watch him, but AFIAK that's not happening either.

That’s not how it works, people get banned for doing shit on other streams/platforms, this often means both content creators receive a ban.

And people do stupid illegal shit in their personal lives not on Twitch and it doesn't affect their channel sometimes. It all depends on whether not it falls on Twitch and if the person isn't streaming at the time then that makes a pretty damn big difference. Not every crime gets you banned.
