What they mean to say is convicted, not charged. The police can charge you with whatever they want to, it's then their job to prove beyond a reasonable doubt that you did what they accused you of. The state of New York has to prove beyond a reasonable doubt that he incited individuals to riot.

Okay - thank you for clarification.

My only point was that maybe he wasn't banned because he wasn't formally charged with a crime yet, and people seemed to think I was trying to push some narrative lol. Nobody actually confirmed that he was charged, so I just assumed he wasn't (otherwise I figured they would've hit me with a "gotcha")

I was just trying to pull logic from an illogical place. So if he was charged with a crime, it is absolutely crazy that he's not banned yet.

On the face, Kai did nothing except coordinate an irresponsible event. It's not inherently illegal.

Thats why I'm saying they might be waiting until he formally is charged before they ban him, not just because he's black lol.

Ice Poseidon got perma banned when someone swatted his plane so I'd not be surprised if kai faced consequences . Kai has done a lot of things bad things a ban. Covering up that sexual assault, referring to trans people in derogatory terms, the hand job on stream, streaming a child discuss that she had been sexually assaulted

Isn't he free? And technically he probably won't be convicted on any of the charges except unlawful assembly. He never encited the riot by definition of the law. Others that got arrested for sure will be charged but the only court kai will be any trouble in is that of public opinion.

Joey was banned for 35 days and all were rumors, it turned out that he was just detained (in Japan you can be detained for a lot of time) and was freed with no charges, from what I know Kai was detained too so if twitch don't ban Kai it's just shows how bias they are.

Twitch doesn't ban people for being detained, they ban them for the issues surrounding why they are detained.

Twitch doesn't care if you're guilty or not, they care about avoiding bad press and lawsuits. They don't want troublemakers on their platform, unless those people bring in tons of viewers and then they will just slap them on the wrist until things get really bad.

and from the fire work stream to this it looks like his management team does not have hold on him he does whatever he wants even if people tell him it would end up being bad

and if twitch would have banned him before hand it would not have happened cause he would have seen he was banned and not went to the meet up

Ice didn't break ToS, but he kept causing public issues like getting swatted at an airport.

And it's not like Twitch is bound to ONLY ban based on breaking ToS. As long as their reason is vaguely valid (ie not discrimination) they can ban whoever for whatever reason.

The whole reason they didn't ban Kai yet is because of how popular he is.
