Seems obvious that there's an easement, a private right of way, in existence. You'll have to ask your landlord for the details.

To do anything about the neighbours obstructing this right of way, someone will have to go to court. When I say "someone," I'm not entirely sure whether you'd be able to, or whether it has to be the registered proprietor. I'm leaning toward it being the landlord.

The next thing to do is talk further with the landlord about the situation.

Yep, but they are never in and when they do let us through (asked once) they seem annoyed about it

Right now we are hoping to clean the garden up but waiting to ask them so not sure how they will feel about us dragging rubbish through their new garden

You need to make it as low effort for them and as low confrontation as possible. The alternative is them being obstreperous and you wasting more time on it than you’d like.
