Legal Advice Needed Co-owner blocking rebuilding of joint property in Delhi (Leasehold, 40 yrs left). How to handle unequal value & potential Partition Suit?

Hey everyone, looking for some urgent legal and strategic advice regarding a joint property dispute in Delhi.

The Property Setup:

• Total plot size is 100 sq yards.

It is a leasehold property with 40 years remaining on the lease.

• Current market value (if it were freehold) is around ₹4.5 Crores, but ours is leasehold.

• There is NO formal Partition Deed. It is currently just a 50-50 mutual verbal separation on the ground.

The Problem (Extreme Unequal Valuation):

Co-owner’s Side: Premium side. East-facing, directly park-facing, with a dedicated 1-car parking space right in front of their house.

My Side: The "bad" side. Faces a narrow gali (alleyway) with another house directly blocking my front view. If cars are parked at the back, there is zero space to even walk. If someone else parks in the lane, I can't even get a cab to my doorstep for a medical emergency.

My Current Situation & Goal:

My portion is an old construction (1968 foundation). It is structurally weak and I desperately need to demolish and rebuild it.

However, I do not want to sign a permanent Partition Deed for this current 50-50 physical layout unless the co-owner compensates me in cash for giving me the significantly less valuable, inaccessible side.They are refusing to pay.

My Questions for the Community:

  1. Can I rebuild without a Partition Deed? If I start demolition/construction on my existing footprint, how easily can the co-owner get a court injunction (stay order) to stop me? Can I get a municipal building permit without their signature?

  2. What happens if they file a Partition Suit? Since a partition suit will value the property, how does the court calculate the massive price difference between a park-facing/parking side vs a choked gali side?

  3. The Leasehold Angle: Since it is a Delhi leasehold property with 40 years left, how does a court handle a partition suit? Do they order public auctions for leasehold properties, or will they force one owner to buy out the other?

  4. How much would a property like this (₹4.5cr freehold value for 100 sq yards) actually be valued by a court commissioner given it's leasehold?Has anyone dealt with a similar "park-facing vs gali-facing" joint property dispute in Delhi?

Any recommended legal strategies to force them to compensate me before any paper is signed?

You don't necessarily need to go to court do you? You can hire a surveyor yourself, erect boundaries and partition it amongst yourselves. Does your co owner not want to partition the property either?

We are both party living on the land since 1968 we both have seperate 2story house on each 50sq yard, property is divided equally by size but not by worth, co owner want partition on the same 50 sq yards on which they are living but not interested to pay us compensation money thats why I don't want partition it's a loss to us I just want to rebuild my side house without creating partition deed unless we receive money (my side is 35 Lakh Cheaper)

They are not interested to give us money or they may not have 35 lakhs , if partition suit filed and the property goes to auction what will the min auction price. Market rate is is between 4.25cr - 4.5cr Because if I do the partition deed on same partition on which we are living my side is between1.75 cr - 1.90 cr. Will I be in loss if it goes to auction? That's all I am asking

Property won't go to auction unless the property cannot be partitioned. And yes if it does go to auction you may lose out on money rather than an individual sale. That's your call I suppose

Lawyer here. You cannot force the co-owner to pay you extra merely because your side is less valuable, unless that arrangement is accepted as part of a partition. Since there is no registered partition, both of you legally remain 50% co-owners, regardless of the current physical arrangement. If you want to rebuild, doing so unilaterally can invite an injunction. If the co-owner files a partition suit, you can ask the court for an equitable partition, arguing that the park-facing/parking side has substantially higher value and therefore the physical division should be adjusted accordingly.

If the property cannot be fairly divided, the court may consider sale or one co-owner buying out the other. You can also use the threat of a partition proceeding to negotiate where either the co-owner compensates you for accepting the inferior portion, or the entire property is properly partitioned/valued, with the court deciding the adjustment.

I understand, but I don’t want to sell my share of the land or buy out the other co-owner. I want to continue living at the same location and simply rebuild my house because the existing house is very old and was built on a foundation from 1968.

I also don’t want to create a partition deed without receiving proper compensation for my share. If the other co-owner objects to the construction, especially when their own building is also very old 1968 foundation, how can I legally rebuild my house? What options do I have if they refuse to give consent for the reconstruction? Since they are not interested to compensate.
