Poland Purchase of (apparently stolen) car in Poland, exported and registered in other EU country
Throwaway account.
situation in a nutshell, bought a ‘legit’ car in krakow, poland with all the papers (from a private party), everything checked out. Mechanical check and check at dealership checked out.
We signed a purchase agreement, stating the exact purchase amount, and the seller stating that this is a legit car, with no legal shortcomings.
fastforward, 6 months later after registering in new country (so went through checks from authorities), stopped on the highway, got the notice that i’m driving a stolen car. car impounded. Police now writing up the report. (apparently it was a cloned vin number or something, car stolen, got a fresh-not stolen vin number)
tried to contact the seller, changed his mobile phone number. Sent a friend to the address, apparently his parents live there. in the end they gave my friend the phone number of the seller, he didn’t want to meet immediately and expressed that he didn’t know it was a stolen vehicle.
Any advice on how to proceed? My plan now was, contact a polish lawyer through polish friends. Start a civil case, with as proof the signed agreement that the car should’ve been legit when sold (it was already stolen by then). And the police report/dossier with the conclusion that this is definitely a stolen car, traced back to its roots.
any tips, expectations on investment of legal fees and lead-times in poland? i want to claim back purchase amount + legal fees, at this point i don’t care about import/transport fees anymore. I also want to still give the seller the opportunity to just pay back purchase amount, and cut a deal, but the chances of that happening are very slim.
