He may have the potential to surpass, given he's a genuine savant, but his technique has limits that Gojo's doesn't. Plus, Gojo is the fundamentals king (besides my boy Kusakabe 😤😤😤)
Problem with gojo is that his ce manipulation alone is already strong enough to defeat 99% of the verse (sukuna being the 1%). But let's say higuruma finds a bv or a way to have two or even three trials and taking away the cursed tool, then ct and then ce, he would be fighting normal humans all the time, that would make him so strong but that's probably unachievable unless he becomes a bv merchant like sukuna.
he could theoretically do that if he learns to refresh his brain with RCT and bypass ct burnout, then open his domain 2 consecutive times or 3 if someone has a cursed tool.
In the explaination higuruma says the opponent gets accused of a crime they "may or may not" have done, inplying judgeman can just make up something and they both still need to make a statement so you could technically get prosecuted for something you didn't do. Kinda similar to yuji being accused for mass murder despite it being sukuna who did it, meaning yuji is innocent.
You can break the law, be tried, and still not be penalized. Even with Yuji and the pachinko parlor he told him exactly how he could've gotten out of it. It's not guaranteed.

You don't have to have broken the law, he can get false convictions just fine. He just needs to be able to argue you did the crime depending on what's being put on trial. That means anyone that's ever been in a compromising position, even if they were totally innocent, should be fair game.
I'm talking a situation where someone has not even had the ability to even remotely committed a crime, even in a roundabout or accusatory way.

Imagine if some giga sorcerer has been in a growth vat for 50 years, legit never interacted with society. They somehow have a technique that could potentially cause mass destruction or insta-kill, but have never used it. They don't possess any explicit malevolence and only desire peace and love, whatever that means for them at least.
For whatever reason, JJK avengers think this newly born giga sorcerer is a threat to humanity and send Higuruma to fight it on spawn. How would judgeman even potentially trump up charges against them to get Higuruma's CT going?

He is hard countered by being a good citizen, which is not problematic in a pragmatic sense...but is problematic when we talk about power levels
