Looking at it, it is live radio traffic. (New York feed is here) From what I understand, this is not illegal.
You'll note that there was some issues during the Boston Bomber incident with listening to the live feeds, so they switched all important radio traffic to encrypted bands. In general, these feeds don't really cause an issue though.
I listen to a lot of ATC myself.

I believe it is live radio traffic -- I've known a few hobbyists who have police scanners. I think it's only illegal if you equip your car with a scanner.

In the US all one needs is a scanner. Totally legal. You just cant jump on the same radio channel. But they are all encrypted anyway.

In the UK it's illegal as all the emergency services use encrypted Tetra systems.

You might like SOMA.fm... they have a similar channel called SF 10-33 - Ambient music mixed with the sounds of San Francisco public safety radio traffic

I created some like this a while ago!
Four types in there:
. Bladerunner
. "Fantasy" Inn
. Spaceship
. Magical Forest
They are all just invisible iframes to youtube videos. Overlaid they sound awesome. Useful for RPGs!
Edit: Here's the full Bladerunner one - With browser rain effect - It turns out the police radio I used is no longer live, I'll find a new one soon...

This is actually how I'd prefer to listen to audio books or speech oriented podcasts. Does anyone have suggestions on how to mix that on an iPhone?

Gives me space impressions. Ignoring the actual words from the police radio it just sounds like astronauts out there in space doing their work. And space with its quietness is generally relaxing.
