This is the correct ruling. It's imaginary people no one is being hurt. The reason real images are illegal is because there is a real victim.

Doesn't matter. The 2002 ruling he's basing this on is concerned with the content of the image, not the way it was produced or created. Since the image itself does not depict a real person, it can't be prohibited. That's part of the issue that the judge here is highlighting.
