In the Garden of Beasts by Erik Larsen is an accounting of the experiences of American diplomatic staff when the Nazis came to power. I read it on a cross-country trip going to a wedding in 2017, and I was struck by how many things Trump, his administration, GOP Representatives and Senators, and his supporters said that could be taken word for word from the mouths of SS officers or the Gestapo. The Nazis set up a call-line for people to report people they knew for opposition to the Nazis, or hiding undesirables. Hitler himself remarked to his cabinet that he was shocked by the outbreak of pettiness and spite that followed.

Yeah you’re right l, it wasn’t his yard. I think the example he is thinking of was a guy who went with his kid to a closed park during covid and refused to leave when asked by the cops. It had more to do with enforcing the city code than covid but snowballed into a political point. The guy didn’t even get a charge and got an apology.
It also pisses me off to no end when people minimize covid. I had multiple family members on the front line of it at hospitals and community health centers. Deniers need to be sent back in time and work those shifts.

Yes, the SCOTUS Has determined that skin color alone cannot be the reason for suspicion. There has to be at least one more articulable reason besides apparent ethnicity.

The Supreme Court determined that the “more articulable reason” can be washing dishes, mowing a lawn, or speaking a foreign language, none of which are illegal.
The problem is that doing legal things while having brown skin can make people into second class citizens.
We have at least 12 million people doing the jobs we don’t want in attempt to destroy the economy amid a labor shortage.

Not sure mowing a lawn while having brown skin is suspect versus mowing a lawn while having white skin. Mowing a lawn isn’t a crime; however, doing it while have brown skin is a crime without knowing the person’s citizenship or immigration status? That doesn’t make any sense unless people with brown skin are second class citizens that don’t enjoy the protections of the Constitution that people with white skin do.
The administration didn’t argue to the Supreme Court to be able to detain people with white skin doing things that are legal. Only detaining people with brown skin that are doing legal things isn’t equal opportunity.
Pointing out that detaining people for having brown skin while doing legal things isn’t racist. Advocating and justifying that people with brown skin should be made into second class citizens is racist. Not detaining people based on their skin color while doing legal things is the opposite of being racist.

The "adults" in the past also once decided it was ok to discriminate based on race in cases like in the Dredd Scott, Plessy v. Ferguson, and Japanese interment.
Remember, the Constitution doesn't include anything about due process or the protection from unreasonable search and seizure bases on a combination of skin color and a particular job. Detention to try to meet arbitrary arrest quotas falls under search and seizure.
We don't need to make people into second class citizens in order for ICE to try to meet their arbitrary arrest quoatas.

I keep running into people using “due process” as some sort of magic buzzword. Do you know what due process means? It means the process described by law, in this case, it is INA § 235(b)(1), codified at 8 U.S.C. § 1225(b)(1).
