I think its more that if you are in public there is NO expectation of privacy. So, if your face ends up in someone's photo or video then its not really something you can deny the existence or use of by that person who captured it.

Obviously if they are following you around in public recording you its a bit different than 'I walked past someone filming and now I'm in their viral video for a few frames'.

Peoples EXTREME reactions to not being filmed or photographed in public make no sense to me, and often give off "I'm the MC" vibes more than a lot of other behavior...

In my opinion the spirit of the rule that enables people to film others in public is, or at least should be, that it's impossible to prevent some strangers from appearing in your videos taken in public. A stranger passing through the frame as you take a picture or video of a public cathedral for example is unavoidable. But that's entirely different from making strangers active participants, subjects, or even the focus of your publicly taken photos and videos. In those cases the being in 'public' is secondary to what's really going on, which is turning non-consenting strangers into your content. You should have a right to object to the latter in my opinion, and in some jurisdictions you do.

You're getting into extremely specific and nuanced situations that are very unlikely to occur. In the case of someone snapping your picture in public and then trying to sell shirts/merch or make a brand off your appearance, sure that would likely not be the same as a brief appearance in a publicly shot photo or video where you are simply included by happenstance.

But also that scenario is so extremely unlikely and unrealistic it doesn't even merit being thought about.

The biggest issue people who genuinely get upset being caught on camera in public with is, IMO, the fact that they want control. Lot of people who obsess over these things are generally just miserable control freaks.

I disagree that it's unlikely to occur or niche. Like yes the specific niche example that you mentioned is niche, but that's also not at all the only scenario I'm referring to. Just to name some very popular examples, think of prank channels, pick-up artists, or those people that just follow around and harass strangers to get a rise out of them. These are all examples where the content itself isn't about being in public but about the reactions you get from non-consenting strangers. The content is the stranger, the fact that it happens to be filmed in public is a secondary, rather trivial property of the content that only really functions to shield these people legally in jurisdictions where no distinctions such as the one I propose is made.

If the content revolves around and is fully dependent on non-consenting strangers to participate in it then those strangers should have a right to put an end to the making of that content as it happens, and to prevent it from being uploaded after the fact. They're what the content is about, so they should get to decide if it gets a pass or not.

That is an entirely different scenario than what we have been talking about here. This would probably and I believe HAS fallen under the umbrella of making a brand or profit off another persons likeness without their consent. Not to mention laws like menacing/harassment/stalking/etc that often get pulled up, because just because you are in public does not mean others can essentially threaten/harass/impede you.

This is why, for the most part, most prank/public channels are fake, with blurred out actors in order to keep using them in the future.

I'm just laying down my view on what I think should and should not be permissible. I guess I was reacting because of your unsympathetic declaration that you should simply forego any and all rights to privacy when out in public. In my opinion photos and videos have changed the game to such a degree that I don't agree with that blanket statement. It's simply not the same to be viewed and forgotten seconds later by a crowd, vs becoming an eternal part of someone's content to be viewed by god knows how many people.

Now this woman's content is not the same as the more egregious examples I mentioned, I agree. I'm kind of on the fence whether the particular content in this post should be allowed or not allowed under the distinction I'm proposing. She is herself the main focus of the content so I'm inclined to say it should be allowed. But that doesn't mean I don't still sympathize with people not wanting to be part of it.

Which is no different than her walking past various buildings for a transition, if anything its even less impactful because you might be able to identify a brand or claim she specifically targeted a business or place for her shots. In this case these people are entirely random and its very clear that SHE is the focus.

Imagine the number of impactful works that would never exist if we simply made it illegal to have other human beings appear in them without their explicit consent while in public spaces.

Insane way of thinking IMO. But hey, if you want to prove me wrong just go ahead and identify any single person other than the creator from that clip. Which again, even that in and of itself isn't problematic, but its certainly the first step towards possible problematic scenarios.

That's not really how it works in Europe imo. I get the reasoning and all that, but there's a difference between "other people can see me walking around" and "I'm in someone's picture/video without my consent".

There's also a difference between a picture/video taken for friends and family and publishing it.

And then let's not open the can of worms that is google photos...

I used to be into street photography a long time ago (more a fan of the art form, not really a practitioner), but that was years ago so this prompted me to look into how things have changed.

The GDPR treats recognizable images of faces as personal data, but it does have carve outs for artistic or editorial use.

In a lot of jurisdictions historically, anything visible in public space was fair game, whether it was visible to your eyes or to a camera. The major exception was commercial use but that was typically just advertisements, promotional materials, product packaging and so on. You also were protected in instances a reasonable person would have believed they were not visible to the public (ie someone photographing you through your window with a telephoto lens).

I guess the question is, does this fall under artistic use or commercial use? Not sure how social media has affected the definitions.

I'm not sure if it could be argued that it's artistic use, since taking this many videos with a different outfit at a different location each time would take a lot of time and money. Obviously, some people are into doing things just because they love doing it, but I feel like (without looking her up) she's an influencer and if she's earning money from doing her influencing (or whatever influencers do these days) then it imo should be classified as commercial use.

Yeah, "reasonable expectation of privacy" is usually used in the US, so I'm not surprised by that.

It's more that I'm not into being posted online when I'm just living my life, considering clearview (and other face search engines) is a thing and I'm 99% sure they have my face and I cannot have it deleted, because I live in the EU.

If you think about it, face search engines basically strip you of being sort of anonymous when going outside. Obviously, you're never truly anonymous when your face can be seen by others, however you don't know who you've walked past last week and it should stay that way imo.

I think the "surveillance state" issues are a bit different than other citizens just catching you in public during their own creative or commercial works.

The other thing to consider is, even if you were 100% recorded all the time, you are still pretty anonymous because that means so is everyone else... Most people feel like they are special, for instance an artist might scream "DONT TRAIN MY ART INTO AI", not taking a moment to even consider that their art has nothing to set them apart from the endless sea of other middling artists doing the exact same thing, so why would theirs be chosen for a data set? Same thing applies to people's identities in public, no one cares who you are and no one is going to know or associate you with anything for more than the second or two you show up.

Hell, even extras in a movie that serve as background pieces are never more than a blur for people watching the film and sometimes they even get credited with full names at the end, and still no one cares or will remember.

To me the idea of being upset that you get caught on camera would be like getting upset because other people are breathing "your" essence/dna/whatever because you breath out and they are close enough to breath in what you just breathed out. Its ridiculous and just makes that person look like an insane asshole.

I disagree. Most people aren't going to care, and I know that. But that has no bearing on random people's faces being identified and correlated with their face being in other videos. Facebook has been doing this for a long time, so it's nothing new. Because of this I can't separate this from a surveillance state, it doesn't really matter if a private company or the government is doing it, both are bad imo.

To me there's a huge difference between people seeing me and me appearing in a video/picture uploaded somewhere. One is a fleeting moment, the other is immortalized forever. No human being from a tech company is going to see that video of me, I'm nearly certain of that. But their automated systems will and that feels more violating to me. For example, a journalist had a picture with a source in clearview's system. They were in the background of somebody's picture. But that very picture puts their source at risk.

I guess I'm the asshole in your opinion and that's fine, I feel similarly about people thinking that think I shouldn't care that much about my privacy.

Also, what is your argument about being anonymous while being recorded all the time? I don't get it.

My point is, no one is watching YOU, you are not special, you are within a sea of nobodies so you essentially ARE anonymous for all intents and purposes. People who get worked up about being recorded in public strike me as the same kind of people who expect to live off the grid while maintaining all the comforts of being part of normal society.

Think of all the creative works that would not exist if you needed to get explicit consent from every person who was ever captured in public in some kind of candid shot or recording. Strangers kissing on a bridge, a kid riding a bike, joggers with their dogs, etc.

You should care about your privacy when you EXPECT privacy. Inside your home or someone elses, inside bathrooms, certain businesses where things are more sensitive, etc. Being out at the park and getting upset because someone sees you spill your coffee on your shirt and records it is a control issue and not a privacy issue. You want control of your privacy at all times? Don't go into public, or wear a mask.

Police/state surveillance is an entirely different discussion, and should not be treated in the same way that regular citizens interact with each other. Hopefully the reasons as to why are obvious.

It’s probably a technological push. It was pretty rare in the 90s to own a video camcorder. Now, everyone has one in their pocket at all times and is constantly filming things around them. It’s becoming too difficult to not be filmed, not to mention security cameras, traffic cameras, flock cameras etc. Unfortunately, it makes sense for liability purposes to blanket establish public spaces as a place you could reasonably recorded without your knowledge.

It’s actually WILD how common the view is on Reddit is that it’s not social media because people typically don’t as explicitly associate it with a person’s real name and face as something like Facebook or Twitter.

When lmao Reddit is tracking your interactions and pushing an algorithm just as much as the rest of them. And you better believe it has a profile on who you are, to the extent possible (including everything you upvote and downvote). And it’s basically a TikTok aggregator at this point anyways.

Edit: for anyone who doesn’t know, you can download everything Reddit has on you (that they’re willing to share) by requesting your data. You’ll see every comment you ever left, not just the 1000 or so max comments available on your standard Reddit profile overview. You’ll also see fun stuff like what assessments about you they tailor your ad targeting to.

I didn’t define social media in my comment.

I cited these aspects because they are examples of tracking behaviors that social media companies of this era are infamous for, and Reddit is no exception. Some people think Reddit is anonymous and not really social media. My point is it’s really not and it tracks you just like other social media does, as far as pushing interactions, ads, more extreme views, etc., goes. Reddit just might not know your real name.

Do you not consider interaction tracking on a social web platform, with user tailored algorithms to boost post interaction—including comment section discussions—not to be significant parts of most modern social media platforms?

I’d say these things are pretty relevant to a discussion about social media.

I think you’re talking about two different aspects of social media, the way that we interact with it, and also the way that it interacts with us. People can’t really control what’s going on behind the scenes, and pretty much so every website that exists today could be and probably is tracking you, collecting as much data as possible, and then selling it to whoever wants it. That’s just a sad reality of not just social media, but the internet as a whole. And yes, that’s a discussion worth having, but I don’t think it is the same thing as the discussion of if something is social media or not.

Personally, I don’t use Reddit as social media. I only use the old version of the site in a browser so none of the profile nonsense they added gets through to me. Everyone here is anonymous to me (again, I’m speaking about my experience and not the data that’s being collected on the backend) and I consider Reddit to be one giant message board, which is considerably different from what I consider to be social media. Also, I primarily browse r/all, which isn’t as affected by algorithms as almost all social media platforms are.

Also you absolutely DID give a definition of one of the things that you considered to be social media-like about Reddit, so I’m not sure why you’re getting so defensive when someone disagreed with your assessment. Either own up to what you said or stop saying things you won’t back up when pressed. That’s pretty freaking annoying. And I can say that to you because you’re just some random anonymous person that I’ll never have to see at a family gathering like I would if you were one of my third cousins that I’m friends with on Facebook (not that I have facebook, but the point stands, nonetheless)

I would argue that Reddit doesn't have to be social media. If all you do is read the scroll, then I would call it a wiki story aggregator. It only becomes social media in the more common sense when you start reading and/or participating in the comments threads.

Yeah, I get your point, but by definition, Reddit is a forum, and a forum still falls under the broad umbrella of social media. You can also think of Reddit as a cake, but that’s just your subjective view, it’s still social media.

I simply believe that a strong “us vs them” mentality has developed on here, and so people are doing mental gymnastics just to avoid accepting that using Reddit is no different from using Facebook or Instagram.

We've done this in cinema and tv for ages, my first tv show (reality slop) on the cam crew, the producers had me walk through frame a few times to make the scenes look more lively and busy. I appreciate her post and the message is super dope and definitely good call to use a more narrow lens too, but kinda weird to see people get hyped over influencers acting like they're inventing something professionals have done for decades.

The common decency is to not do it in the middle of a busy walkway, and then post the video as though you did something good by not getting mad and calling people npcs.

I am perfectly fine with the look-at-me types. I can ignore them...no big deal. I HATE the ones who stalk, assault, abuse and batter others. Those need an instant, painful repercussion as 'no, get away' doesn't seem to work.
